32 SECTION 6. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase,
33 or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
34 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and

The request is to revise the previously approved PCD to
extend the hours of operation for Arkansas Children's
Hospital Clinic.

Staff recommends approval of the requested PCD zoning.
The Planning Commission voted to recommend approval
of the PCD zoning by a vote of I I ayes, 0 noes and
0 absent.
The Planning Commission reviewed the proposed PCD
request at its August 27, 2015, meeting and there were no
registered objectors present. All property owners located
within 200 -feet of the site along with the Tulley Cove,
Westchester and Pinnacle Valley Neighborhood
Associations were notified of the Public Hearing.
BACKGROUND
The applicant is proposing to extend the hours of operation
for Arkansas Children's Hospital (ACH) medical clinic
located at 16101 Cantrell Road, Suite 114. The clinic is
currently open from 8 am to 4:30 prn Monday through
Friday. The applicant has indicated to better meet the
needs of families in West Little Rock and to make the best
use of the facilities in both West Little Rock and the main
campus, ACH is requesting to revise the PCD for their use
to allow the clinic to operate with the maximum hours.of
7 am to I I pm up to seven (7) days per week.
ACH proposes to continue the existing services and to offer
additional services, including general pediatric care and
urgent care clinic, as is done on the main ACH campus.
The urgent care services provided would approximate that
given at a regular pediatrician's office. The clinic will not
provide true emergency or trauma care. A maximum of
25 patients can be served at any given time. There are no
plans to expand the clinic beyond its current footprint, nor
to modify the existing facility to serve more patients.

Arkansas Children's Hospital has operated their West Little Rock Pediatric Clinic for several
years, in the Bella Rosa Shopping Center at 16101 Cantrell Road, Suite 114. The clinic has
operated under restricted hours of 7 a. m. to 8 p. m., currently open from 8 a. m. to 4:30 p. m.
Monday -Friday- We understand that hours of operation were restricted under the terms of a pre-
existing Planned Commercial Development for the Center.
To better meet the needs of families in West Little Rock, and to make the best use of ACH
facilities both in WLR and on the main campus, ACH requests a modification to that PCD, to
extend the hours and days of operation as stated below.
The requested maximum hours of operation are 7 a.m. to midnight, up to seven days a week.
ACH proposes to continue the existing services, and to offer additional services, including general
pediatric care and urgent care clinic, as is done on the main ACH campus. The urgent care
services provided would approximate that given at a regular pediatrician's office. Le., the clinic
will not provide true 'emergency' or trauma care.
A maximum of (25) patients can be served at any given time. There are no plans to expand the
clinic beyond its current footprint, nor to modify the existing facility to serve more patients.
The property manager, Vaugh McQuary of RPM Management, has given permission for ACH to
take this action. His letter of approval is attached. Also attached is a letter from ACH stating their
approval for Cromwell Architects Engineers to represent them.
We understand that certified letters to adjoining property owners, and posting of a sign, may be
required. Included is a check for $205, for application & sign fees.
Please let us know as soon as possible of any other requirements or restrictions.

Good morning! I mentioned the 11 pm concerns of the Planning & Development Staff to ACH. The 11 pm closing time
should work with the ACH Urgent Care mission, so this will be fine.

Children's Clinic at Bella Rosa
The 200 -foot property owner notices need to be mailed by Wednesday August 12th. Also staff has concerns with allowing the clinic
to operate until midnight. We are suggesting the clinic be allowed to operate until 11 prn seven days per week. There was concern
a few years back with the pizza restaurant and their hours of operation. Staff is aware the clinic would not likely generate the
number of cars as a restaurant but we feel if we open up midnight for the clinic there is potential the restaurant will also request to
be allowed extended hours.

- We just today received the property description, and Aaron is going to try to get a list of neighbors from a title company
ASAP. We MAY make 7/10; if not, I guess we will have to postpone.
- For the hours of operation - yes, 7am to midnight, 7 days. No intent to actually DO that right now, but they want the
permission so they can continue the planning to see if it is a feasible option for this Urgent Care / after hours chnic. It is a
win-win for the hospital, children and parents in WLR, if this does prove to work.

The sign posting is ok. There are only a few questions related to today's subdivision committee meeting. if you want to sit this one
out and get me the responses that is fine.
1. Provide notification of the property owners located within 200 -feet of the development including
the certified abstract list, notice form with affidavit executed and proof of mailing. The notice must be
mailed no later than July 1, 2015. The Office of Planning and Development must receive the proof of
notice no later than July 10, 2015.
2. Does the request include the allowance to extend the hours of operation for AR Children's Clinic
7 am to midnight up to seven nights per week? The cover letter is not clear on the hours being
requested.

Donna, I had a long visit with Gene Pfeiffer Friday afternoon. I learned the whole story of the Bella Rosa development
from his point of view. And by the way, Donna, he asked me to tell you hi, and thanks for thinking of him. He was
serious. Said he thought a lot of you.
So, besides the fact that he is upset that the Bella Rosa Center even exists, he said to say that he is too tired to argue any
more and does not have a great concern here, and that he would not object to the rezoning for extended hours for ACH.
Gene was concerned about the possibility of ambulance service. I reassured him that the possible additional use would
be like a'doc-in-the-box', or even a doctor's office, without ambulances.
One thing he was upset about was the lighting. He said that it was not supposed to shine onto his property, but he says
that it does.
I drove by Friday evening and did not note that, but have not looked at it in detail. It would be prudent to keep an eye on
that, though, Leslie. To b sure any ACH-directed lighting, at leastr is'Dark-Skies' compliant.
Is that enough for you, Donna? Gene is a man of integrity, and I think if he says it he will stick by it.
