A variance is requested from the
area regulations of Section 36-256
to permit construction of new
residence with a reduced side yard
setback.
Applicant's Statement: The
current structure located at 522
East 21st encroaches the property
line of 520 East 21st by 10 feet.
The City did not have this
information when it acquired the
property as part of its Model Block
Program. The City proposes to
build an affordable home at 518 and
another at 520 East 21st to be sold
to a low-income family. Without
this variance the City cannot
attain the goal of providing two
affordable homes in this model
Block.

East 21st Street has a 60 foot right-of-way, its a 36 foot
asphalt street, there does not exist a sidewalk, staff has
no objections to plan. Repair any damaged curb and gutter
or driveway apron with construction.

B. Staff Analysis:
The City of Little Rock, as part of its Model Block Program,
proposes to construct a new, single family residence on the
property located at 520 East 21st Street. The home will
then be sold to a low-income family. when the City had the
property surveyed, it was determined that a portion of the
house on the adjoining property to the east actually
encroaches onto this property. The encroachment involves up
to 9 feet of the neighboring residence.
The City still desires to construct a new home on the
subject property, in spite of the encroachment. In an
effort to maintain at least a 5 foot separation between the
new house and the encroaching structure, the City proposes
to shift the new house closer to the west property line,
resulting in a reduced side yard setback of 2.5 feet. The
ordinance requires this R-4 zoned lot to have a side yard
setback of 4.5 feet. The proposed structure will have an
eave/overhang of 16 inches.
The City also owns the lot adjacent to the west. An
affordable home is to be constructed on this lot as well
(518 East 21st Street). The house on the lot to the west is
proposed to have a side yard setback of 7.5 feet, providing
for a separation of 10 feet between the two new proposed
residences.
Staff believes the proposal to be reasonable and supports
the requested side yard setback variance. Without the
variance, the proposed affordable home cannot be built on
th e property. The property to the west is most directly
impacted by the reduced side yard setback. The City also
owns this lot and has made adjustments by proposing a side
yard setback of 7.5 feet for the home to be built on that
lot.
C, Staff Recommendation:
Staff recommends approval of the requested side yard setback
variance subject to compliance with Public works Comments.

Rick Jones was present representing the applicant. There were no
objectors present. Staff presented the item and a recommendation
of approval, with conditions.
Mr. Jones offered no additional comments.
In response to a question from staff, Mr. Jones stated that the
issue had been reviewed with the title company and the presence

of the neighboring house encroaching on the lot would not prevent
the issuance of title insurance. He stated the title would show
the encroachment and any potential buyer would be made aware of
the situation.
A motion was made to approve the requested side yard setback
variance subject to compliance with Public Works Comments. The
motion was approved by a vote of 6 ayes, 0 noes, 2 absent and
1 open position.
