Public Works Comments: z-6197 Immanuel Baptist Church 1600 West 10th Street Lot 8, Block 4, Fitzgerald's Addition R-4 A variance is filed under the location of off-street parking provisions of Section 36-507 to permit a church parking lot on residentially zoned property. Residential use no longer exists in this area. All adjacent properties are used for parking, office and commercial uses. Vacant lot Paved and landscaped parking lot Indicated construction in the public right-of—way appears to conform to ADA standards and our driveway ordinances. However, a 20 foot radial area should be dedicated at the intersection of 10th and Bishop Streets and curb radius needs to be improved to 31.5 foot radius between these two commercial streets. Ordinances would call for 10th Street to be a 36 foot commercial street and Bishop Street a 36 foot commercial street. Staff can support a waiver of widening requirements for each street with construction. (Check with Bill Henry) List existing widths. B. Staff Anal sis: Immanuel Baptist Church owns the two vacant lots located at the northwest corner of West 10th and Bishop Streets, directly across West 10th Street from the main church building. The lot directly on the corner is zoned 0-3 and the lot adjacent to the west is zoned R-4. The church proposes to develop both lots for parking and tie them into an existing parking lot which extends to the west. The September 30, 1996 Item No.: _3 Cont. Ordinance requires detached parking facilities to be located on property which is zoned to allow the principle use which the parking will serve or they must be approved by the Board of Adjustment. The church is requesting that the Board approve the use of the R-4 zoned lot as a parking lot. The lot is located in an area of properties very nearly solely occupied by facilities and parking lots belonging to Immanuel Baptist Church and Arkansas Children's Hospital. The properties to the north and west have been developed as parking lots. Immanuel Church is located directly across 10th Street and also owns buildings on properties east and northwest of the site. Other office and institution uses occupy properties in close proximity to the site. The proposed use of this R-4 zoned property is not out of character with other uses in the area and should help alleviate a real parking problem in the neighborhood. C. Staff Recommendation: Staff recommends approval of the variance to allow use of this R-4 zoned lot as a parking lot for Immanuel Baptist Church subject to the following conditions: 1. Compliance with Public Works Comments 2. Compliance with the City's Landscape and Buffer Ordinances BOARD OF ADJUSTMENT: (SEPTEMBER 30, 1996) Barry Williams was present representing the application. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. Mr. Williams stated that the applicant would comply with the conditions. He stated that a waiver of the street widening requirements would be pursued at the Board of Directors. A motion was made to approve the variance subject to compliance with the conditions noted in the staff recommendation. The motion was approved by a vote of 7 ayes, 0 noes and 2 absent.
