Public Works Comments: Z-6193 Jon Staton Construction Company 12300 Cherryside Drive Lot 26, Block 4, Cherry Creek Addition R-2 A variance is requested from the building line provisions of Section 31-12 to permit the construction of steps across a platted 25 foot building line. This new house is nearly complete. Due to the slope of the lot, more steps are needed to enter the front door than first estimated. Single Family residence, under construction Single Family residence No apparent Public Works issues. Repair any damaged curb or driveway apron within the public right-of-way with construction. B. Staff Analysis: The applicant has nearly finished construction of a new single family residence on this R-2 zoned lot. Due to the slope of the lot, the front of the house sits higher above grade than first estimated by the applicant. The front wall of the house sits on the front 25 foot platted building line. Steps needed to access the front porch, which appears to be 3.5-4 feet above grade, will have to be built across the building line. The encroachment will be for a distance of approximately 50 inches. The steps will be constructed of brick to match the house and no roof will extend over the building line. September 30, 1996 No.: 7 (Cont. Staff believes the applicant has submitted adequate justification to support the variance. The minor encroachment across the building line will have no effect on adjacent properties. Should the Board approve the building line variance, the applicant will need to do a one lot replat to reflect the change as approved by the Board. The applicant should review the filing procedure with the circuit clerk to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval of the requested building line variance subject to compliance with the following conditions: 1. A one lot replat to reflect the change as approved by the Board. 2. Compliance with Public Works Comments BOARD OF ADJUSTMENT: (SEPTEMBER 30, 1996) The applicant, Jon Staton, was present. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. Mr. Staton offered no additional comments. A motion was made to approve the building line variance subject to compliance with the conditions outlined in the staff recommendation. The motion was approved by a vote of 6 ayes, 0 noes and 3 absent. 2
