A variance is requested from the
height and area exceptions of
Section 36-156 to permit
construction of an accessory
building which occupies more than
30% of the required rear yard.
The variance requested is very
minor in nature (an additional 30
square feet) and should have no
impact on adjacent properties. The
existing house limits buildable
area available for the proposed two
car garage to this location.

No apparent Public Works issues. Applicant is required to
maintain damaged curb, or driveway aprons within the public
right-of-way. Contract for any repairs with the
construction.
B. Staff Analysis:
The owners of the property at 5729 North Country Club Road
propose to construct a two -car, garage and storage room in
the rear yard of their lot. The proposed structure is 24
feet by 20 feet, a total of 480 square feet. Section 36-156
of the Code of Ordinances states accessory buildings may not
occupy more than 30 percent of the required rear yard. In
the case of this particular lot, that limits accessory
buildings to a maximum of 450 square feet. The structure
proposed by the applicants is 30 square feet larger than

allowed by ordinance and occupies 32 percent of the required
rear yard. The structure meets or exceeds all required
setbacks.
A major remodeling of the house on the property has resulted
in the loss of the carport by the construction of a new
addition onto the rear of the home. This addition has also
reduced the buildable area available on the site. Moving
the proposed structure any further out of the required rear
yard would result in reducing either the street side yard
setback or the separation between the garage and the house.
The applicant also desires to maintain yard space between
the two structures.
This minor area coverage variance (30 square feet) should
have no impact on adjacent properties. Staff believes the
request to be reasonable.
C. Staff Recommendation:
Staff recommends approval of the area coverage variance
subject to compliance with Public Works comments.
BOARD OF ADJUSTMENT:

The applicant, Thomas Glancy, was present. There were no
objectors present. Staff presented the item and a recommendation
of approval.
Mr. Glancy offered no additional comments.
A motion was made to approve the area coverage variance subject
to compliance with Public Works Comments. The motion was
approved by a vote of 6 ayes, 0 noes and 3 absent.
