A variance is requested from the
building line provisions of Section
31-12 to permit construction of a
carport and open porch addition
which will cross a platted 25 foot
building line.
The applicant is disabled and needs
covered parking. The addition has
already been built.

No apparent Public Works issues. Applicant is,responsible
for any damaged curb, or driveway aprons within the public
right-of-way. Repair with construction.
B. Staff Analysis:
This issue is before the Board as a result of action by the
codes Enforcement Staff. The applicant recently constructed
a carport and porch addition onto the front of the house
located at 11 Southern Oaks Drive. The addition was
constructed across a platted 25 foot building line. The
carport has a front yard setback of 7-8 feet. Once he was
notified of the violation, the applicant filed with the
Board of Adjustment for a variance.
The applicant states he needs the carport to replace the
original carport which has been enclosed. He states he is
disabled and needs a covered parking area.

The encroachment across the platted building line is fairly
substantial, resulting in a front yard setback of only 7-8
feet. If the structure were truly a carport, basically a
roofed structure with unenclosed sides, staff would more
readily accept the proposal. However, the structure as it
has been built, is actually enclosed to some degree on all
sides. Staff is willing to support a carport addition, to
provide covered parking for the applicant, but cannot
support the structure as it has been built.
If the building line variance is approved, the applicant
will have to do a one -lot replat to reflect the change as
approved by the Board. The applicant should review the
filing procedure with the circuit clerk to determine if a
revised Bill of Assurance is required.
C. Staff Recommendation:
Staff recommends approval of the requested building line
variance subject to the following conditions:
1. A one lot replat of the lot reflecting the change as
approved by the Board.
2. The 12 foot by 20 foot carport addition is to be
unenclosed on all sides other than at the point it
adjoins the house. The walls and enclosures now around
the carport structure must be removed.
BOARD OF ADJUSTMENT:

The applicant, Robert Jones, was present. There were no
objectors present. Staff presented the item and a recommendation
of approval, with conditions.
Mr. Jones stated that he did not want to have to remove the sides
from the structure. He stated that he was disabled and wanted to
have covered parking. Mr. Jones concluded by stating that he
would comply with whatever the Board directed.
Chairman Rowland commented that the structure should remain open
on three sides since it was built into the front yard setback.
He then asked staff if Mr. Jones would have to do the one -lot
replat and obtain a building permit. Staff responded that he
would.
The question was called and a vote taken on the variance request
with the conditions as recommended by staff. The vote was
6 ayes, 0 noes and 3 absent.
