Dan Phillips and Barbara Phillips, his wife, Ben M. 6 Hogan, Jr. and Magalene I. Hogan, his wife, and James S. Hall and Cloressa land D. B. Stough, III and Jerry F4 Stough, his wife ,,Hall, his wife, are the sole owners of the following described lands lying in the County of Pulaski, State of Arkansas, to -wit: Lot 9, Triangle Properties Industrial District, located in the Nh SEk Section 35, TIN, R13W, Pulaski County, Arkansas, more particularly described as: Starting at the Northeast corner of the NEh SEk said Section 35; thence N 01031'20" E 40.0 ft. to a point on the South right-of-way line of Interstate Route No. 30; thence S 62036' W along said South right-of-way line, 2042.2 ft. to the point of beginning of the tract of land described herein; said point being the Northwest corner of Lot 8, Triangle Properties Industrial District; thence S 27024' E along the West line of said Lot 8, 490.0 ft. to a point on the North right-of-way line of Distribution Drive and the Southwest corner of said Lot 8; thence S 62036' W along said North right-of-way line 300.0 ft. to a point on the East right-of-way line of Production Drive; thence N 27024' W along said East right-of-way line 491.65 ft. to a point on the South right-of-way line of Interstate Route No. 30; thence Northeasterly along the arc of a 11,610 ft. radius curve to the left, having a chord bearing and distance of N 63005135" E, 183.6 ft.; thence N 62036' E and continuing along said South right-of-way line 116.45 ft. to the point of beginning, containing 146,089.66 sq. ft. or 3.35 acres, more or less. AND, WHEREAS, it is desirable that all of the above described property be subdivided into lots, blocks, tracts, and streets; NOW THEREFORE WITNESSETH: THAT, WE, the said A. Dan Phillips and Barbara Phillips, his wife, Ben M. Hogan, Jr. and Magalene I. Hogan, his wife, and James S. Hall and /D. B. Stough, III and Jerry F. Stough, his wife Cloressa Hall, his wife, hereinafter termed grantors, have caused said ` tract of land to be surveyed by Edward G. Smith & Associates, a Registered Professional Engineer, or Registered Land Surveyor, and a plat thereof made which is identified by the title Lot 9, Triangle Properties Industrial District, and the date , 19 , and by the signature of the CircuitClerkand ex-officio Recorder of Pulaski County, Arkansas, in Plat Book 3 / Page , and the grantors do hereby make this Bill of Assurance. Owners of lots ,� in this subdivision shall take their titles subject to the rights of public utilities and the public. The filing of this Bill of Assurance and plat for record in the Office of the Circuit Clerk and ex -off icio Recorder of Pulaski County shall be a valid and complete delivery and dedication of the streets and easements shown on the said plat. Hereafter, conveyance and description of any of said lands by lot number as shown on said plat, shall, be a proper and sufficient description thereof. The lots in said subdivision shall be sold by the grantors and shall be purchased by the buyers thereof, subject to the following covenants, to -wit: 1. No building or fence is to be constructed on any lot nearer than the building line noted on said plat. The following front yard, rear yard, and side yard provisions shall be required for the following usage of the property: a. Commercial Use. A front setback of 40 feet is required. A rear yard setback of 25 feet is required. There shall be a 10-foot requirement for side yard setback. b. Industrial Use. A front yard setback of 40 feet is required on all minor streets. The building line shall be a minimum of 10 feet from all side property lines. 2. Each condition and covenant herein contained shall terminate and be of no further effect on January 1, 1990, provided that at any time the then owner of two --thirds of the square feet area in the Triangle Properties Industrial District may, by written declaration signed and acknowledged by or attempting to violate any such covenant or'restrictions, and either to prevent him or them from so doing or to recover'damages or other dues for such violation. 4. The invalidation of any one -of these'covenants or restrictions by judgment or court order shall in no wise effect any of the other provisions, which shall remain in full force and effect. The considerations set forth in items one through four are hereby approved by the City of Little Rock Planning Commission. Dan Phillips and Barbara Phillips, his wife, Ben M. Hogan, Jr. and Magalene I. Hogan, his wife, and James S. Hall and Cloressa Hall, his /D. B. Stough, III and Jerry F. Stough, his wife wife, to me well known as the grantors in the foregoing Bill of Assurance, and stated that they had executed the same for the consideration and purposes therein mentioned and set forth. And on the same day also voluntarily appeared before me, the said Barbara Phillips, wife of the said A. Dan Phillips, Magalene I. Hogan, wife of the said Ben M. Hogan, Jr., and Cloressa Hall, wife of the said James S. /and Jerry F. Stough, wife of the said D. B. Stough, III Hall, to me well known and declared that they had, of their own free will, executed said Bill of Assurance for the consideration and purposes therein contained and set forth, without compulsion or undue influence of their said husbands.
