Public Works Comments: Z-6171 Nicholas E. & Dena Yancey Trujillo/ Ellen Yeary, Architect 5213 Country Club Blvd. Lot 4, Block 18, Newton's Addition R-2 A variance is requested from the area regulations of Section 36-254 to permit construction of an addition with a reduced side yard setback. Applicant's Statement: I am writing to request a side yard setback variance to enable my clients Nicholas E. and Dena Yancey Trujillo to construct a 10 foot by 13 foot (with bay) bedroom addition onto the rear (south side) of their house at 5213 Country Club Blvd. The Trujillos are planning to begin extensive remodeling work on their house and the bedroom addition is an integral part of this project. Because the existing west property line is 1.8 feet from the southwest corner of the house, we are asking that we be allowed tQ extend the west wall an additional 10 feet to the south. Single Family residence Single Family residence Applicants are required by City Ordinance to maintain the curbs, gutters and sidewalks adjacent to property. Any of these damaged prior to or because of construction shall be repaired at the owner's expense. July 29, 1996 Item No.: 6 (CO B. Staff Analysis: The applicants propose to construct a 10 foot by 13 foot bedroom addition onto the rear of their home located at 5213 Country Club Blvd. The existing home has a side yard setback of 1.8 feet. The applicants wish to maintain the existing setback for the new addition. The ordinance requires this R-2 zoned property to have a 5 foot side yard setback. The property adjacent to the west will be the only one impacted by the reduced side yard setback. This adjacent property also contains a one story single family residence. An 8 to 9 foot wide driveway separates this neighboring residence from the common property line separating the two properties. The proposed addition to the applicant's home will be located to the rear of the neighboring residence. The proposed 10 foot by 13 foot, one-story addition should not greatly impact the adjacent property. The applicant should install guttering or some other approved device to assure that water does not runoff onto the adjacent property. No portion of the addition's eave or overhang may extend beyond the property line. C. Staff Recommndatian: Staff recommends approval of the requested side yard setback variance subject to the following conditions: 1. No portion of the addition's eave or overhang may extend beyond the property line. 2. Guttering or some other approved device must be installed on the addition to prohibit water runoff onto the adjacent property. 3. Compliance with Public Works Comments BOARD OF ADJUSTMENT: (JULY 29, 1996) The Chairman asked Richard Wood, of the Staff, to present the staff recommendation and the variance request. Wood offered a brief overview of the application and the staff recommendation which was approval of the application as submitted. At the conclusion of Wood's remarks, Ellen Yeary representing the application came forward. Ms. Yeary offered a brief comment basically saying that she understood the staff recommendation and that they would conform. 2 July 29, 1996 I em No.• 6 Cont. The Chairman asked if the Hoard of Adjustment had any questions. There being none and no one present to object, the Chairman placed the item on the floor for a motion. A motion was made to approve the application as recommended by the staff. The motion was seconded and passed by a vote of 7 ayes, 0 nays and 2 absent.
