Lee Jones and Betsy Hall -Jones 209 North Woodrow Street Lot 3 and North 1/2 of Lot 4, Block 4, Midland Hills, Little Rock, Pulaski County, Arkansas R-3 A variance is requested from the height and area provisions of Section 36-156 to permit construction of a swimming pool which, when added to the area of the existing accessory building, covers more than 30 percent of the required rear yard. The existing accessory building occupies the allowable 30 percent, leaving no room for the pool without exceeding the ordinance limit. The house has a 56 foot front yard setback, reducing the buildable area in the rear yard. Single Family residence Single Family residence The owner of the R-3 zoned property located at 209 N. Woodrow proposes to construct a below grade, 18 foot by 36 foot swimming pool in the rear yard of the property. Section 36-156 states "swimming pools and all appurtenant structures both above ground and below grade of adjacent yard area shall be construed to be accessory structures and conform to the standards of this section." Section 36-156 also states that accessory structures may not occupy more June 24, 1996 Item No.: 2 Cont_ than thirty (30) percent of the required rear yard area in the R-1 through R-4 districts. Based on the thirty (30) percent coverage rule, accessory structures in the required rear yard area of this particular lot are not to exceed 567 square feet in area. There is already a 570 square foot, one story stucco garage/carriage house located in the required rear yard. The addition of the 18 foot by 36 foot, below grade swimming pool will bring the total coverage to 930 square feet, or forty-nine (49) percent of the required rear yard area. Staff believes the requested area coverage variance is reasonable and offers the following justification. The applicant's home has a fifty-six (56) foot front yard setback from Woodrow Street. The front yard setback is more than twice the twenty-five (25) foot front yard required by Ordinance in the R-3 district. With the house being located so far from the front property line, the buildable area behind the home is greatly reduced, pushing more of the proposed pool into the required rear yard area. The proposed pool is below grade, not impacting the providing of adequate light and air as well as not giving the appearance that the land is overcrowded. C. Staff Recommendation: Staff recommends approval of the requested area coverage variance. BOARD OF ADJUSTMENT: (JUNE 24, 1996) The applicant, Lee Jones, was present. There were no objectors present. Staff presented the item and a recommendation of approval. Mr. Jones offered no additional comments. A motion was made to approve the requested area coverage variance. The motion was approved by a vote of 7 ayes, 0 noes and 2 absent. 2
