Zoned: R-2 variance Re ested: A variance is requested from the area regulations of Section 36-254 to permit construction of an addition with a reduced rear yard setback. Justification: A licant's Statement: Our proposal is to build a one story extension on the attached garage. The addition will be on the east side, coming out towards Cleveland Street. To maintain architectural integrity the proposed addition will be the width of the existing structure. This will put it approximately 16 feet from the rear property line as the existing structure is. The purpose of the extension is to allow the Shapiros to park their vehicles, which at this time will not fit, in the garage. The existing garage is simply too short. Mrs. Shapiro is confined to a wheel chair so the Shapiros use a full size Chevrolet van with a wheel chair lift for her transportation needs. The Chevrolet van is too long for the garage. The addition will allow the vehicle to be parked inside for comfort and security. May 20, 1996 No.. 4 (C Present Use of Property Proposed Use of Propel: staff Report- A. Public Works Comments: The addition will be quality construction and will compliment the -existing -structure in style. We appreciate your consideration on this matter. Single family residence Single family residence Public Works recommends that the addition be denied due to small space left between extension and the edge of street. The distance the rear bumper of an automobile will be from edge of pavement in a parked position will be reduced to an unacceptable amount. There does appear to be ample room on the east of existing structure for addition. B. staff Anal sis• The R-2 zoned property at 6400 Cantrell Road contains a two- story brick residence with an attached two-story garage. The structure currently has a rear yard setback of 16.1 - 16.8 feet. The Ordinance requires a 25 foot rear yard setback in the R-2 zone. The applicant proposes to construct a one-story addition onto the garage to lengthen it and provide more room for parking a full size van equipped with a wheelchair lift. The van will not fit in the existing garage. The applicant proposes to construct the addition maintaining the existing rear yard setback of 16.8 feet. The addition will have a side yard setback from Cleveland Street of 9 feet. The Ordinance requires a side yard setback of 8 feet. The property to the north of this site is occupied by a single family residence which fronts onto Cleveland Street. This adjacent residence is located 20-25 feet from the common lot line. The reduced rear yard setback requested by the applicant should have no effect on this adjacent property. The applicant desires to maintain the function and the architectural integrity of the existing garage by constructing the addition with the established rear yard setback. The finished structure will be approximately 20 feet from the curb line of Cleveland Street. Staff believes the requested rear yard setback variance to be reasonable. 2 May 20, 1996 Item No.: 4(Cont.) C. Staff Recommendation: Staff recommends approval of the requested rear yard setback variance. BOARD.OF ADJUSTMENT: (MAY 20, 1996) Stephen Harder, of Schulte Construction, was present representing the applicant. There were no objectors present. Staff presented the item and a recommendation of approval. David Scherer, of the Public Works Department, expressed concern about the setback between the new addition and Cleveland Street. Mr. Harder offered no additional comments. There was a brief discussion of the distance between the addition and Cleveland Street. A motion was made to approve the requested rear yard setback variance. The motion was approved by a vote of 8 ayes, 0 noes and 1 absent. f
