Graham Smith 13200 Ridgehaven Road Lot 25, Carriage Creek, Phase II R-2 A variance is requested from the building line provisions of Section 31-12 for an existing residence which was built across a platted 25 foot building line. The house was built in 1994 and placed so that a corner crosses the building line. The applicant is having a problem obtaining title insurance coverage for a proposed buyer. Single family residence Single family residence B. Staff Analysis: The house located at 13200 Ridgehaven Road was constructed in 1994. The owner of the property is now attempting to sell it. A survey shows that the house was constructed so that it does not sit squarely on the lot and one corner of _ the home extends approximately 3 feet beyond the platted 25 foot building line. This building line encroachment is hampering the applicant's ability to obtain appropriate title insurance coverage for the prospective buyer. The applicant is requesting a variance from the building line provisions of Section 31-12 to remedy the situation. The intrusion involves only a small portion of the corner of the house which is located over 30 feet from the curb of the street. The house has existed for two years and the encroachment has had no effect on neighboring properties. May 20, 1996 Item No.: 1 (Cont_ Short of removing the corner of the existing structure, obtaining the building line variance is the only option. Staff believes the applicant has presented adequate justification for granting the variance. If the building line variance is approved, the applicant will have to do a one lot replat to reflect the change approved by the Board. The applicant should review the filing procedure.with the Circuit Clerk to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval of the requested building line variance subject to a one lot replat of the property, reflecting the change in the building line as approved by the Board. BOARn OF ADJUSTMENT: (MAY 20, 1996) The applicant, R. Graham Smith, was present. There were no objectors present. Staff presented the item and a recommendation of approval subject to a one lot replat of the property. Mr. Smith offered no additional comments. He did state that he understood staff's recommendation. A motion was made to approve the building line variance subject to a one lot replat of the property, reflecting the change in the building line as approved by the Board. The motion was approved with a vote of 8 ayes, 0 noes and 1 absent. 2
