A variance is requested from the
height restrictions of Section 36-
201 to permit construction of a 140
foot tall tower.
The proposed location and tower
height are necessary to provide
optimum service to the public by
fee mandate.

Dedicate right-of-way to 45 feet from centerline. Provide
In -Lieu payment for the cost of a concrete driveway apron to
the right-of-way line. Construction of the drive will be
with the reconstruction of Mabelvale Pike.
Staff Analysis
Sprint Spectrum proposes to construct a 140 foot tall
monopole tower and associated equipment cabinets on this I-2
zoned property. Sprint has leased a 50 foot by 50 foot site
within a At acre tract. The remainder of the tract is
vacant and undeveloped.
Section 36-201 limits metal ground -mounted towers to 75 feet
in height. The radio frequency demands for this site
requires Sprint to exceed the 75 foot height limitation.

The 140 foot height is the minimum needed to provide
acceptable coverage in this area.
All of the surrounding properties are zoned I-2 and are
occupied by a variety of Industrial. and Commercial uses.
There is some single family residential located farther to
the south and east. The base of the tower site is shielded
from this residential by the adjacent industrial buildings.
Two other towers were previously approved by the Board on
property located some two blocks southwest of this site.
The proposed tower should have no effect on the adjacent
properties.
C. staff Recommendation:
Staff recommends approval of the requested height variance
subject to the following conditions:
1. Compliance with the Public Works Comments
2. The barbed wire strands on top of the 8 foot chain-link
fence must not extend beyond the vertical plane of the
fence.
BOARD QF ADJUSTMENT: (APRIL 29, 1996)
Randy Frazier was present representing Sprint Spectrum. There
were no objectors present. Staff presented the item and a
recommendation of approval, with conditions.
Mr. Frazier offered no additional comments.
In response to a question from Kirby Rowland, staff noted that
the correct notice procedure had been followed.
A motion was made to approve the requested variance subject to
compliance with the conditions noted in the staff recommendation.
The motion was approved by a vote of 9 ayes, 0 noes and 0 absent.
