Two year extension of a previously
granted variance to permit
construction of an addition with a
reduced rear yard setback.
On April 29, 1996, the Board granted a rear yard variance to
allow for construction of an addition onto the single family
residence located at 1517 Pickering Drive. There were no
outstanding issues and the Board approved the variance by a vote
of 9 ayes, 0 noes and 0 absent. The approval was granted subject
to compliance with the following conditions:
1. Compliance with Public Works Comments
2. No portion of the structure's eave or overhang may extend
beyond the property line.
A copy of the April 29, 1996 minutes is attached for reference.
Circumstances developed which caused the addition not to be
built. Those circumstances include the relocation of the
applicant and his wife, who both work for Alltel, to Alltel's
office in Glasgow, Scotland. The Scotland assignment is
scheduled to end in July 1998, and the applicant will return to
Little Rock. It is his intent to construct the addition at some
point after his return.
Article Iv, Section 2 of the Board's Bylaws states:
"If an application is approved by the Board, all
permits necessary for the initiation of work shall
be obtained within two (2) years from the date of
approval, unless an extension of time is granted by
the Board. Otherwise, the Board approval of the
application shall be considered void."
The Board's April 29, 1996 approval expired on April 29, 1998.
The applicant was in contact with staff and submitted a letter
requesting that the approval be extended for an additional two
years.
Staff believes the time extension request to be reasonable.
Circumstances have not changed since the 1996 approval.

Staff recommends approval of the requested two year time
extension subject to compliance with the conditions attached to
the April 29, 1996 approval. The approval is to run to April 29,
2000.

The applicant was not present. Staff presented the item and
recommended approval of the two year time extension to run to
April 29, 2000.
The item was placed on the Consent Agenda and approved by a vote

setback.
Applicant's n -: I am
currently a resident of a west
Little Rock home located at 1517
Pickering Drive. I purchased the
property in 1987. The house has
approximately 1,425 square feet,
including three bedrooms and 1-3/4
baths.
On May 4 of this year, I will be
married. My fiance has two teenage
daughters. Consequently, I would
like to increase the living space
in my home. At this time, I would
like to request approval for a rear
yard setback variance permit.
The house, as well as the lot and
the area at the rear of the house
has been well maintained. Rather
than sell this home and buy another
one, we would like to build an
additional bath, closet, sitting
area and sun room to the rear of
the house. The cost of this
addition will be approximately
$20,000.00. It will be done by
reputable, licensed construction
company. The proposed addition
will replace an existing deck.
With this addition, the rear of the
house will be extended
approximately 12'-13'. The east
and west walls will not be
extended.

A. En ineerin issues:
There is a relatively large area
(approximately) 22' deep on the
west side and 33' deep on the'east
side) that extends from my property
line south to a creek. This
property belongs to the City of
Little Rock and it is my
understanding that it is defined as
a greenway. I will continue to
maintain the greenway, and it will
not be affected by the proposed
addition.

Repair of any damaged curb, gutter and sidewalk is the
responsibility of the property owner according to City
Ordinance.
B. Sraff Analysis:
1517 Pickering Drive is located in an R-2 zoned subdivision
of detached zero -lot -line residences. The lots were platted
so as to allow for a 110" foot setback on one side of each
lot. This lot currently contains a 1,425± square foot
residence and detached garage which is typical of other lots
in this phase of the development. Other residential uses in
the development include "common wall" zero -lot -line homes
and townhouses. The applicant's home now has a rear yard
setback of 13± feet with a 6 foot deck attached to the rear
of the home. The applicant proposes to remove the deck and
construct an addition onto the home which will extend to the
rear property line, resulting in a rear yard setback of "0"
feet.
The lot is relatively narrow and shallow, being 45+ feet
wide and 110 foot deep. The detached garage is located on
the front of the lot, pushing the residence toward the rear
and reducing the buildable area available to expand the
home. There is a 40-50 foot wide, platted open space area
located behind the lot which separates this property from
the properties further to the south. This 40-50 foot wide
strip was platted as a "green -space" and contains a
creek/drainage way. This green space separation will reduce
the impact of the reduced rear yard setback and gives the
appearance of a full rear yard.

Staff believes the proposal is reasonable and is supportive
of the variance. The applicant needs to review the
Subdivision's Bill of Assurance to determine if the proposed
construction violates any of its provisions. With the
proposed addition coming so near the rear property line, the
applicant needs to be aware that no portion of the
structure's eave or overhang may extend beyond the property
line.
C. staff Recommendation:
Staff recommends approval of the requested rear yard setback
variance subject to the following conditions:
1. Compliance with Public Works Comments
2. No portion of the structure's eave or overhang may
extend beyond the property line.
SHARD OF ADJIISTMENT: (APRIL 29, 1996)
The applicant, Harold Davis, was present. There were no
objectors present. Staff presented the item and a recommendation
of approval, with conditions.
Mr. Davis briefly stated his reasons for needing to expand the
house. He stated that he understood and accepted the conditions.
A motion was made to approve the requested variance subject to
the conditions outlined in the staff recommendation. The motion
was approved by a vote of 9 ayes, 0 noes and 0 absent.
