A variance is requested from the
Height and area exceptions of
Section 36-156(2)c to permit
construction of a 12 foot by 20
foot detached garage which, when
added to the area covered by an
existing accessory building,
exceeds the 30% rear yard coverage
limit.
The site has no off-street parking
and there is no room to add a
garage onto the house. The lot is
only 37 1/2 feet wide, which
reduces the area coverage available
for accessory buildings in the
required rear yard.

Alley was platted 20 feet wide. Concrete drives are
required to be 5 feet from property line by Ordinance.
Repair any damage to curb, sidewalk or pavement with
construction.
B. Staff Analysis:
1806 N. Tyler Street is a narrow (37.5 feet) lot containing
a single family home and an accessory building. The
accessory building was built many years ago as a garage but
now serves as a storage building. There is currently no on-
site parking on the property and the applicants park on the

street. They desire to construct a new, 12 foot by 20 foot
detached garage on the property which would take access off
of the alley. The new structure will meet all required -
setbacks; however, when the square footage of the new
structure is added to the square footage of the existing
accessory building, the total area of the two structures
exceeds the area coverage allowed in the rear yard.
Accessory structures are not to occupy more than 30% of the
required rear yard; an area of 281.25 square feet in this
case. The existing accessory building and the proposed
garage will occupy an area of 365.6 square feet or 39% of
the required rear yard.
The narrow width of the lot reduces the square footage of
the required rear yard and thus reduces the amount of
buildable area available. If the lot were 50 feet wide, as
is typical in the neighborhood, the area coverage allowed in
the rear yard would be 375 square feet. The proposed new
structure meets all setbacks and exceeds the rear yard
setback. It is not out of character with other structures
in the area; most of the properties in this block have
accessory buildings along the alley. Staff does not believe
this minor area coverage variance of 84 square feet will
negatively impact any adjacent properties.

Staff recommends approval of the requested area coverage
variance subject to compliance with the Public Works
Comments.
BOARD OF ADJUSTMENT:

The applicant, Billie O'Neel, was present. There were no
objectors present. Staff presented the item and a recommendation
of approval subject to compliance with the Public Works Comments.
Ms. O'Neel addressed the Board in support of her request. In
response to a question, she stated that she understood the staff
recommendation and Public Works Comments.
A motion was made to approve the requested area coverage variance
subject to compliance with the Public Works Comments. The motion
was approved by a vote of 7 ayes, 0 noes, 1 absent and 1 open
position.
