The commission approved with conditions and amendments that Conditional Use Permit. We are placed in a position of deciding on an appeal in the short time period provided by city code and city ordinances). Further, should our group appeal to the Board of Directors, whose decision might then result in a filing in District Court, we are requesting your immediate help. Tony, we expected to see at the hearing on March 17, a recent survey, to scale, certified by a registered land surve or, and a copy of a site plan, reflecting all physical improvementsro op sed by the applicant. Questions and answers at the neighborhood meeting with the applicant indicated that the above would be provided. What we saw at the hearing was a drawing of an approximate 4000 square foot building, The information presented by the applicant to the commission for the city's action was far from that which was approved. We did find at the bottom of an undated and unsigned drawing a hand written notation, indicating that the structure for which the applicant was requesting approval was different from that which the commission was considering. We believe that the Planning Commission and the Board of Directors purposefully used the word "shall" while establishing city codes and ordinances to protect the rights of single family neighborhoods. A gentleman appearing in favor of approval of Z -6096-C, mentioned that the site included a lot AND a Tract of Land. Is there a survey, recent or otherwise, confirming that this application bears out that statement? To simply grab a picture out of the air makes it impossible to know if waivers or variances would be required by law. Statements made by the applicant at our neighborhood meeting leads us to believe that such would, in fact, be required. On another matter that will impact our decision, please confirm that the imposed conditions under which the city approved this commercial business to operate, have been met. To wit: (1) that the existing school campus currently has 15 parking places, properly striped as set forth in the code; -(2) that there are not now nor has there been an enrolled student.over the age of nine (9). (Z -6096-C) SYNOPSIS FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION BACKGROUND Action Required I Submitted By Ordinance 4Resolution Approval Information Report Bruce Moore A record objector is appealing the Planning Commission's action in approving a revised conditional use permit for Chenal Valley Montessori School located at 15717 Taylor Loop Road. I None Approval of the Conditional Use Permit; Denial of the Resolution The Planning Commission reviewed this issue at its March 17, 2005 meeting. There were three objectors and one supporter present. The Commission voted to approve the application by a vote of 6 ayes, 2 noes, 2 absent and 1 abstaining (Floyd). All owners of property located within 200 feet of the site, all residents within 300 feet who could be identified and the Westerchester-Heatherbrae, Westbury and Secluded Hills Neighborhood Associations were notified of this request. The Chenal Valley Montessori School is located on the R-2 zoned property at 15717 Taylor Loop Road. On March 14, 1996, a conditional use permit was approved to allow for construction of a 1,620 square foot, residential -style building and a 13 -space parking lot. The school was to have an enrollment of 30 students. BACKGROUND CONTINUED On April 30, 1998, a revision to the C.U.P. was approved to allow for expansion of the student enrollment to 48 students. The second floor of the existing building was finished -out to accommodate an office and two classrooms. No other changes were proposed. On June 22, 2000, the Commission denied a revised C.U.P. to allow for construction of a two-story building on the site, which was to contain a gymnasium and 4 classrooms. Also included was the addition of 4 parking spaces and expanding the enrollment to 98 children. The applicant appealed the denial to the Board of Directors. Prior to the Board hearing, the proposal was modified slightly in that the building was reduced in scale. On August 15, 2000, the Board voted to return the item to the Planning Commission. On September 14, 2000, the Commission approved the modified C.U.P. The opponents then appealed the decision to the Board. On November 8, 2000, the Board passed Resolution No. 10,925 which rescinded the Commission's approval, at the applicant's request. On October 3, 2002, the Commission denied a C.U.P. which would have allowed for the development of a new Montessori School on nearby Forest Lane to replace this campus. The new, 5 -acre campus was to include 3 buildings, 31 parking spaces and an enrollment of 110 students. The applicant appealed the denial to the Board. Again, the proposal was modified prior to the Board meeting. On January 21, 2003, the Board voted to return the item to the Planning Commission. On February 20, 2003, the Commission approved the C.U.P. There was no appeal. The applicant subsequently determined it was too expensive to build the Forest Lane School. The applicant now proposes to construct a second building on this Taylor Loop Road site. The proposed building will be one- story in height and will be built in a residential style with brick and vinyl siding and a pitched, shingled roof. The building will contain two classrooms, an activity room and a school office. The building will be 3,000 square feet in area. Associated with the new building is an expanded parking lot and drop-off area. The school currently has an enrollment of 80 children. Forty- five are located at this site and 35 are located in rooms at the nearby Central Baptist Church. The applicant proposes to consolidate the school to this site and to cease using the church. No increase in the school's enrollment above 80 children is proposed. 2 BACKGROUND CONTINUED On March 17, 2005, the Commission voted to approve the revised C.U.P. NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. We were approved to --P' build a 6000 square feet two-story building on this site in either 2000 or 2002. However, we decided that this structure was going to be too overwhelming for the neighborhood. The new building we have planned will be 3000 square feet and a ane -story residential type structure. It will be composed of four rooms: two classrooms, an activity room and a school office. The activity room will be used primarily for before and after school care. The exterior will be brick on three sides and vinyl on the back side. We will use residential roofing. At present our classes are located in our main building at 15717 Taylor Loop. We also lease two classrooms from a church located in the next block_ We will not be able to lease this space next year. These children who attend class in the church are already enrolled in our school and the traffic flow on Taylor Loop should not change. Our sign which stands in the front of the school on Taylor Loop Road is approximately six feet by six feet. It is encased by brick on three sides. The American flag flies above the sign. There are no plans at this time for additional signs along the streets. In the future, however we request permission to identify what classes or offices are located within a particular building. These signs would be approximately two feet by four feet or smaller. 2. CVMS has fourteen employees. Seven employees are full time and `7&lr work from eight o'clock to 3:oo p.m. Two employees come to work ��ax ee-s at 9:00 a.m. and leave at 11:00 a.m. Three employees come to work two thirty o'clock and one employee comes to work at three .hey * * 3.
