Carpenter, City Attorney, and Julia K. Hudson, Assistant City Attorney, who respectfully come before this Court and move this Court to Dismiss the pending action with prejudice. 1. Jim and Shirley Nettles (the "Nettles") objected to Ms. Dorothy Moffett's ("Moffett) request to apply for a Conditional Use Permit for the Chenal Valley Montessori School located at 15717 Taylor Loop Road, Little Rock and they objected to an expansion of a building at that site. The application for the Conditional Use Permit was denied. 2. Moffett appealed the decision of the Planning Commission which was overhand by the Little Rock City Board of Directors. 2. At this time, Moffett has withdrawn her request for a Conditional Use Permit to increase the number of students at the Taylor Loop Road to Eighty (80) and to expand any of the buildings at that site. 3. Moffett does not have Eighty (80) students at the Taylor Loop Road School and she is not permitted by the Arkansas Department of Human Services to have this number of students. Based upon Ms. Moffett's withdrawal of the application for the Conditional Use permit increasing the number of students to Eighty (80) and increasing the site of the structures at the site, the Nettle's concerns have been met. ITEM #10 SUBDIVISION COMMITTEE COMMENTS: (OCTOBER 23, 2008) The applicant was not present. Staff briefly described the proposed conditional use permit revocation to the Committee. Staff noted that the school in question had a new location to the north along Cantrell Road, and that the property along Taylor Loop Road was no longer needed for the school use. I have no intent to increase the number of students to eighty (80) at this site. I am curroutly licensed by the Arkansas Department of Human Services to have thirty-eight (38) students at this facility_ I have no plans at this time to petition the Arkansas Department of Human Services to incitease the number of students at this facility from the number I am ourreotly licensed to serve. I am the owner/applicant of Chenal Valley Montessori School located at 15717 Taylor Loop Road, Little Rock, Arkansas. 2. On June 7, 2005, the Little Rock Board of Directors took up the matter of a Public Hewing & Resolution Rescinding the Little Rock Planning Commission's action in approving a revised conditional use permit for Chenal Valley Montessori School, 15717 Taylor Loop Road. 3. The Little Rock Board of Directors denied the Resolution to Rescind the Little Rock Planning Commisslon's action and approved the conditional use permit approved by the Little Rock Planning Commission on June 7, 2005. 4, The conditional use permit included allowing the Chenal Valley Montessori School to construct a one story structure that resembling in a residential style and add fifteen (15) parking spaces in order to accommodate an increase in students from forty-five (45) to eighty (80) Students, S. I am no longer working toward adding a one story structure and fifteen (15) parking spaces to the real property known as 15717 Taylor Loop Road. I have no plana to EXHIBIT 4. Further, she is not moving forward with her plan to increase the size of any building at Taylor Loop Road. She now has a second location for her school. 5. She has also withdrawn her application for a Condition Use Permit that would have allowed the increased number of students and enlargement of the structures at the Taylor Loop site. (Exhibit "B") 6. Based upon Ms. Moffett's withdrawal of the application for the Conditional Use permit increasing the number of students to Eighty (80) and increasing the site of the structures at the site, the Nettle's concerns have been met. WHEREFORE, the Nettles and the City of Little Rock move this Court to dismiss the present matter with prejudice and to grant all other relief to which the parties may be entitled. Also, the increased number appeared to be 80. Please let me know if I am incorrect on these numbers. Also, read thru the document to make sure I hit all of the points that Mr. Nettles had issues with. On March 14, 1996, a Conditional Use Permit (C.U.P.) was approved to allow for the construction of a 1,620 square foot, residential -style building and a thirteen (13) -space parking lot. At the time of approval, the school was to have an enrollment of thirty (30) students. On April 30, 1998, a revision to the C.U.P. was approved to allow for the expansion of student enrollment to forty-eight (48) students. The second floor of the existing building was finished -out to accommodate an office and two (2) classrooms; however, no other changes were proposed at that time. On June 22, 2000, the Little Rock Planning Commission denied a revised C.U.P. to allow for the construction of a two (2) -story building on the site, which was to contain a gymnasium and four (4) classrooms. Also included was the addition of four (4) parking spaces and the expansion of the school's enrollment to ninety- eight (98) children. The applicant appealed the Planning Commission's denial to the Little Rock City Board of Directors; however, prior to the Board hearing, the proposal was modified slightly reducing the building in scale, and on August 15, 2000, the Board voted to return the item to the Planning Commission. On September 14, 2000, the Commission approved the modified C.U.P.; however, opponents of the project appealed the decision to the Board of Directors. On November 8, 2000, at the applicant's request, the Board passed Resolution No. 10,925, which rescinded the Planning Commission's approval. City Tony and Dana - You may recall that we moved to dismiss Jim Nettles' appeal of the Board's decision to uphold the Planning Commission's decision in the Chenal Valley Montessori School matter. The basis of the motion was the failure of Mr. Nettles to follow a particular rule of appellate procedure. Judge Sims granted our motion and Mr. Nettles appealed. Last week, the Arkansas Court of Appeals reversed Judge Sims and said that Mr. Nettles had substantially complied with the rule. The court ordered that the matter be sent back to Judge Sims' court to hear Mr. Nettles' appeal. Tom and I agree that we should ask the Arkansas Supreme Court to review and reverse the Court of Appeals decision as it is in direct conflict with one of its own previous decisions as well as a recent decision of the Arkansas Supreme Court. I have prepared a petition for review and plan on filing it this week. If it is granted the Supreme Court will either affirm the Court of Appeals and the case will be heard on its merits by Judge Sims or it will reverse the Court of Appeals and the case will be over. If the former, it just means we will have a trial on whether the revised CUP was properly granted. I will keep you advised on the status of the case. Let me know if you have any questions. S.) are requesting permission to build an addition to our school campus on Taylor Loop Road. We were approved to build a 6000 square feet two-story building on this site in either 2000 or 2002. However, we decided that this structure was going to be too overwhel sling for the neighborhood. The new building we have planned will be 3000 square feet and a one-story residential type structure. It will be composed of four rooms: two classrooms, an activity room and a school office. The activity room will be used primarily for before and after school care. The exterior will be brick on three sides and vinyl on the back side. We will use residential roofing. At present our classes are located in our main building at 15717 Taylor Loop. We also lease two classrooms from a church located in the next block We will not be able to lease this space next year. Them children who attend class in the church are already enrolled in our school and the traffic flow on Taylor Loop should not change. We are not asking for an increase in enrollment. This year we have eighty children enrolled. In the event we receive approval, our plan will be to move thirty-five children to the new building. Our sign which stands in the front of the school on Taylor Loop Road is approximately six feet by six feet. It is encased by brick on three sides. The American flag flies above the sign. There are no plans at this time for additional signs along the streets. In the future, however we request permission to identify what classes or offices are located within a particular building. These signs would be approximately two feet by four feet or smaller. 2. CVMS has fourteen employees. Seven employees are full time and work from eight o'clock to 3 : oo p.m. Two employees come to work at 9:00 a.m. and leave at 11:00 a.m. Three employees come to work two thirty o'clock and one employee comes to work at three thirty.** 3. CVMS is open five days a week between the hours of 7:30 a.m. and 6:00 p.m. Classes begin for toddlers and primary students at 8:30 a.m and end at either 11:15 a.m., 12:30 p.m., 3:00 p.m. After three the children are in Extended Care. Parents can pick their children up anytime after three o'clock and before six o'clock. ** 4. Our sign which stands in the front of the school on Taylor Loop Road is approximately six feet by six feet. It is encased by brick on three sides. The American flag flies above the sign. There are no plans at this time for additional signs along the streets. In the future, however we request permission to identify what classes or offices are located within a particular building. These signs would be approximately two feet by four feet or smaller. 2. CVMS has fourteen employees. Seven employees are full time and work from eight o'clock to 3:oo p.m. Two employees come to work at 9:00 a.m. and leave at 11:00 a.m. Three employees come to work two thirty o'clock and one employee comes to work at three thy, * * 3. CVMS is open five days a week between the hours of 7:30 a.m. and 6:00 p.m. Classes begin for toddlers and primary students at 8:30 a.m and end at either 11:15 a.m., 12:30 p.m., 3:00 p.m. After three the children are in Extended Care. Parents can pick their children up anytime after three o'clock and before six o'clock. ** 4. There is one street light directly in front of the school and one in front of the house on Taylor Loop Road and Robyn Lane (next to CVMS). 5. Our dumpster is located on the tract of land next to the school drive way (entrance side). This is the tract of land which the school has leased. 6. The school's parking has fifteen parking spaces plus some of our teachers prefer too park on the property to the right of the entrance driveway.* This area is closer to the door they use on the side of the building. There will be an additional six parking spaces on the proposed site. 7. Our playground is located on the left side (starting at the comer of the building and wraps around and ends at the back of lot 2. There is a chain length fence across the front and six foot wooden fence which completely encircles the playground and ending at the back of lot 2. This wooden fence also backs up to lots 3, 4 and 5. There will be a wooden six foot fence separating lots 1 and 2. The school is considering a three foot rock wall around the edge of property touching Montgomery and Taylor Loop Road. Properties to the east and west are zoned residential, therefore, the buffer ordinance requires an a nine (9') foot wide buffer strip; however, the landscape ordinance will requires an average width of nine (9') feet and at no point less than 6'-9". A six (6) foot high opaque screen, either a wooden fence with its face side directed outward, a wall, or evergreen plantings, is required along the eastern and western perimeters of the site. The landscape ordinance requires a three foot (3') wide minimum landscape strip between the parking lot(s) and the building, or in the general area. The City Beautiful Commission recommends preserving as many existing trees as feasible on this tree covered site. Credit toward fulfilling Landscape Ordinance requirements can be given when preserving trees of six (6) inch caliper or larger. Curb and gutter or another approved border will be required to protect landscaped areas from vehicular traffic. X.
