Justification: Applicant's Statement: we are requesting a variance in the setback requirement on the north property line of our lot in Foxcroft Addition to within five (5) feet of said line to construct a two -car garage. Due to an increase in the size of our family, we are proposing an expansion to the north side of our home. It is our plan to enclose our existing garage and convert it into a den/family room, leaving us with the need to build a new two - car garage. Because of the shape and slope of our lot, it is not feasible to construct the new garage in any location other than the one that we are writing to request. Our lot is pie -shaped and narrows from the street to the back line and the slope drops off dramatically from the front to the back line. The excessive sloping to the rear of the lot would require large amounts of dirt work to construct the new garage to the rear of our home. Public Works Comments: This property lies within Zone AE (100 year Floodplain). A Development Permit is required prior to construction. Owners of property are required by City Ordinance to maintain curb and gutter. Repair any curb that is damaged during construction. B. staff Analvs is : The owners of the property at #59 Tallyho Lane are proposing to substantially remodel their home by enclosing the existing garage and converting it into a den/family room and by adding a new, two -car garage. The proposed new garage addition will have a side yard setback from the north property line of 5 feet. The Ordinance requires this R-2 zoned lot to have a minimum side yard setback of 8 feet. The lot is unusually shaped, being 116.6 feet wide at the street and 50 feet wide at the rear property line. Due to the location of the house on the lot, it is difficult to build a functional garage without a side yard variance. The new garage will be constructed over the existing, paved driveway. The house directly to the north is located 20-25 feet from the property line and is separated from the applicant's property by a driveway and yard space. The proposed garage addition should have no impact on this adjacent property. The 5 foot side yard setback requested by the applicant directly corresponds to a 5 foot wide easenfent which extends along the north property line. Section 31-172 of the Code of Ordinances states "No building or structure may be erected over or in an easement." The applicant needs to be aware that no portion of the new garage's eave or overhang may extend beyond that easement line. Staff believes the proposal to be reasonable and supports the requested variance. C. 9taff Recommendation: Staff recommends approval of the requested side yard setback variance subject to the following conditions: 1. No portion of the garage addition's eave or overhang may extend into or over the 5 foot easement along the north property line. BOARD OF ADJUSTMENT: (FEBRUARY 26, 1996) The applicant, Paul Lanier, was present. There were no objectors present. Staff presented the item and a recommendation of approval, with conditionst Mr. Lanier stated that he was not sure of the addition's eave and was concerned that it may extend over the easement. Mark Alderfer looked at plans which Mr. Lanier had and stated that it appeared to him that the pitch of the roof was such that the eave line could be pulled back. A motion was made to approve the requested side yard setback variance subject to the two conditions noted in the staff recommendation. The motion was approved by a vote of 7 ayes, 0 noes and 2 absent.
