Public Works Issues: Z-6093 Ramsey, Krug, Farrell and Lensing 5800 Evergreen Road Lots 3-B, 3-C and 3-D, Hillside Village 0-3 and R-2 A variance is requested from the location of off-street parking provisions of Section 36-507 to permit an encroachment by an office parking lot into an area zoned R-2. There is no on -street or adjacent off-street parking available. In order to create adequate parking, this curvilinear realignment and encroachment is necessary. Construct directional handicap ramps at intersections according to City standards. B. Staff Anal sis: The subject property is located at the northwest corner of Evergreen and Pierce Streets. The property is zoned 0-3 with a 50 foot wide, R-2 zoned strip adjacent to Evergreen. The site is occupied by an office building and its associated parking lot. In an effort to provide some additional on-site parking, the applicant proposes to redesign the parking lot which is located on the south side of the office building. The proposal is to redesign this parking lot in more of a curvilinear arrangement which will result in a net gain of 12 additional parking spaces. The January 29, 1996 item n redesigned, curvilinear parking lot will intrude a maximum of 13 feet into the R-2 zoned strip along Evergreen. The R-2 zoned buffer along Evergreen was put in place in 1965 when the 50+ acres to the north was zoned as the proposed site for the Baptist Medical Center. This 50+ acres has subsequently been developed as a mixture of offices and apartments and Baptist Medical Center was located off of the west end of I-630. The 13 foot encroachment into the R-2 zoned buffer will result in a 37 foot deep buffer, at its narrowest point. The buffer widens back to 50 feet as the new parking lot curves back to the north. The 37 foot deep buffer exceeds that which would be required under the current Buffer ordinance. The current ordinance requires a 12.55 foot buffer for this 251 foot deep property. The R-2 property is fairly well covered with pine trees and the property directly across Evergreen is occupied by Pulaski Heights Junior High School. Staff believes the proposal to be reasonable and supports the requested variance. C. Staff Recommendation: Staff recommends approval of the requested variance from the location of off-street parking provisions of Section 36-507 to permit an encroachment by an office parking lot into the R-2 zoned property subject to compliance with the following conditions: 1. Compliance with the Public Works Department Comments 2. The new parking lot is to be designed in compliance with the City's Landscape and Buffer ordinances. BOARD OF AD.TDSTMENT: (JANUARY 29, 1996) Gary Dean was present representing the applicant. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. The Board was informed that there had been a problem with the notices. The applicant had mailed the required notice form on January 19, 1996 via regular mail. After being informed that the notices should have been sent certified mail, the applicant remailed them on January 23, 1996. A motion was made to waive the bylaws and accept the notices as mailed. The motion was approved by a vote of 8 ayes, 0 noes, 0 absent and 1 abstaining (Borchert). A motion was then made to approve the requested variance subject to compliance with the Public Works Department comments and the 2 January 29, 11.96 Item No.; 3 -(Cont.) new parking lot being designed in compliance with Landscape and Buffer Ordinances.
