variances are requested from the
area regulations of Section 36-254
and the building line provisions of
Section 31-12 to permit construction
of a walkway addition with a reduced
front yard setback and which crosses
a platted building line.
The lot drops away from the street.
In order to have a level entry way
from street level to the house, it
is necessary to extend the raised
walkway approximately 6.5 feet past
the building line.

The right-of-way for Scenic should be 50 feet versus platted
40 feet. Dedicate 5 feet of additional right-of-way.
Driveway to be constructed allowing access to head -in
parking shall be constructed such that the edge of drive is
5 feet from property line and the width of the driveway does
not exceed 20 feet at the property line. The depth of this
parking area should be such that 20 feet exists beyond the
new right-of-way line.
The retaining wall needs to be on the property side of the
new right-of-way. The street may be widened to 13.5 feet
from centerline and plans for this construction shall be
submitted by a professional engineer. They shall include a
sidewalk and taper approved by traffic engineering. Design
of the retaining wall shall also be submitted for approval.

The owner of the home at 5714 Scenic Drive is proposing to
remodel the house by converting the one car garage into the
kitchen and by adding a deck onto the side of the house
which will provide access into the new kitchen. The
property slopes dramatically down from the street so that
although the structure appears to be one story at street
level, it is actually two stories in height. In order to
have a level entry way from the street level into the
kitchen, it is necessary to construct a raised walkway
extending from the new deck, across the platted 17 foot
building line to a point approximately 7 feet from the front
property line.
Although the walkway will be 4 feet above grade at the point
nearest the front property line and 9+ feet above grade at
the front wall of the house, it will be at grade with the
street.
Staff believes the applicant has presented adequate
justification for the variance. The proposed walkway is not
out of character with similar structures on other lots in
the area and staff believes the proposed variances will have
no impact on adjacent properties.
If the building line variance is approved, the applicant
will have to do a one lot replat to reflect the change
approved by the Board. The applicant should review the
filing procedure with the Circuit Clerk to determine if the
replat requires a revised Bill of Assurance.
Staff Recommendation:
Staff recommends approval of the requested front yard
setback and building line variances subject to the following
conditions:
1. Compliance with the Public Works Comments
2. A replat of the lot reflecting the change in the
building line as approved by the Board
BOARD OF ADJUSTMENT

The applicant, Curtis Bailey, was present. There were no
objectors present. Staff presented the item and a recommendation
of approval, with conditions. Mr. Bailey offered no additional
comments at that point.
After a discussion of the Public Works comments by Cindy Dawson,
of the City Attorney's office, it was determined that there was

no nexus to require the dedication of right-of-way through this
variance issue.
Mr. Baxley had indicated a desire to widen the pavement of Scenic
Drive to provide space for on -street parking. The Hoard
determined that the right-of-way dedication should be tied to
that project and not the proposed deck and walkway.
A motion was made to approve the requested front yard setback and
building line variances subject to a replat of the lot reflecting
the change in the building line as approved by the Board. The
motion was approved by a vote of 9 ayes, 0 noes and 0 absent.
