Dear Mr. Asbury:
Please refer to your letter dated January 17, 2023, from GBMc & Associates, requesting a
modification to SWL 2011-00362-4. Under authority of Section 404 of the Clean Water Act (33
U.S. Code 1344), DA Permit No. SWL 2011-00362, which authorized the placement of dredged
and fill material in waters of the United States associated with filling a 1.18-acre man-made pond
in order to restore the aquatic habitat of the previously impacted intermittent stream, is hereby
modified to accommodate a minor deviation in channel location and installation of a double 5
feet x 7 feet box culvert. The project will also include a temporary stream crossing over Rock
Creek. The temporary crossing will be removed as soon as possible after construction is
complete and contours returned to pre-existing conditions. The project is located in Rock Creek
and an unnamed tributary to Rock Creek, in the NW 1/4 of section 1, T. 1 N., R. 14 W., Little
Rock, Pulaski County, Arkansas.
This letter becomes a part of and should be attached to your original permit. The activity
shall be constructed and maintained as described in the permit. All conditions of the original
permit remain in effect. It is your responsibility to understand and comply with the conditions of
the permit and to make your employees or agents involved in the operation continuously aware
of the permit conditions. If changes are proposed in the design or location of the activity, you
are required by law to submit revised plans to the District Engineer for approval before
construction of the change is begun.
