Dear Planning and Development Department:
Please accept the enclosed PZD Short Form Application along with the other enclosures.
The development rationale of this application follows:
The subject property is an historic 1913 house that fell into serious disrepair the by prior
owners. It had been abandoned and overgrown for many years, and vagrants had been
breaking into the property. My wife, Beverly J. Foster, owns the property across the street at
2701 West Markham Street, which she renovated in 1984 and at which she has since operated
her chiropractic clinic. We purchased the subject property in 2016 to clean up and improve the
site and help the neighborhood. Over a two-year period, we completely renovated the house,
replacing all systems, and we landscaped the grounds. Upon completion, we listed the property
with Airbnb and VRBO in an effort to recoup the renovation costs. The property has been
successful as a short-term rental and the project could not have been accomplished without the
ability to conduct this rental activity. Airbnb and VRBO have been very contentious about
setting rules of use, and they have collected and paid city taxes on our rentals. We request that
we be permitted to continue to use the property as a short-term rental.
As for the legal structure, we formed an Arkansas limited liability company, Markham Vernon,
LLC, to own and operate the property. When we secured final financing for the project, the
bank required us to place ownership of Lot 4 (on which the house is located) into our individual
names, Thomas Martin Davis and Beverly J. Foster.
