Blaylock, Registered Professional Engineer, dated /jar-/S 1951 and recorded in Plat Book lo , page $ 9 , in the office of the Pulaski County Recorder, showing the new bounds and dimensions of the property being replatted thereby and the new descriptions and locations of the affected lots and streets, which new descriptions are set forth hereinafter in. colum 4. A11 lands located in Adarns Addition to the City of Little Rock, the owners of which have executed this Bill of Assurance and Replat, which owners and the lands owned by each are listed hereinbe- low, shall be henceforth forever known as being located within the Replat of Adams Addition to the City of Little Rock; and each and every deed of conveyance for arr lot therein describing the same by the number or Mun- bars thereof, as shown on the attached '.aplat of Adams Addition to the City of Little Rock, and as further identified herein, shall always be deemed sufficient description thereof. The undersigned owners hereby dedicate to the public forever an easement of way on and over the streets as shown by said Replat of Adams Addition to the City of Little Rock, to be used as public streets. There are strips of ground as shown on said Replat of Adams Addition to the City of Little Pock and marked "Utility Easement" and "Drainage Easement" which are reserved for the use of public utilities and for drainage purposes respectively, subject at all times to the proper authorities and to the easements herein reserved. Owners of lots is tho Replat of Mama Addition to the City of little Rock shall take their titles subject to the rights of public utilities and the public. The riling of this Bill of Assurance and the Replat of Adams - 2 - aoo,g 695 PAGE 42 (7) No trailer, basement, tent, shack, barn or other out- building erected on any lot in the subdivision shall at any time be used as a residence, temporarily or permanently, nor shall any residence of a temporary character be permitted, (8) Buildings and improvements shall conform to all applicable laws, codes, ordinances and regulations which relate to the construction and improvements on residential property, (9) No building shall show evidence of continuing settle- ment, leakage, decay or other conditions impairing the safety or sanitation of the 4welling, (10) Foundation and footings shall be of masonry, concrete, steel or comparable materials and capable of support- ing required loads, (11) All mechanical plumbing, heating, and electrical •- equipment must meet the minimum requirements estab- lished in local codes and ordinances as they apply to residential properties. All restrictions and covenants set forth hereinabove shall apply to any and all structures which shall be moved into or relocated within the area covered by this Bill of Assurance. The covenants and restrictions set forth hereinabove, are to run with the land and shall be binding upon all parties hereto and all persons claiming under the parties hereto for a period of twenty (20) years from the date of filing of this Bill of Assurance with the Pulaski County Recorder, and shall automatically extend for an additional twenty (20) year period unless this Bill of Assurance is amended, cancelled or supplemented in the manner as set forth in the following paragraph. Said covenants and restructions shall not be amended, cancelled, supplemented or extended beyond the terms provided in the preceding para- graph unless an instrument signed by the owners of at least sixty percent (60%) of the lots affected by this Bill of Assurance, if any, filed pur- suant to the following paragraph is placed of record with the Pulaski County Recorder agreeing to amend, cancel, supplement or extend said cove- nants and restrictions in whole or in part. It is expressly agreed by the undersigned owners that in the event all owners of property located in Adams Addition to the City of Little Rock have not executed this Bill of Assurance and Replat attached -4- eo% 695 PnGF 43 hereto at the time of filing same, that subsequently any number of other owners of property located in Adams Addition to the city of Little Rock not already subject to this Bill of Assurance may subject their lands to the provisions hereof by filing similar Bills of Assurance with the attached Replat of Adams Addition to the City of Little Rock with the Pulaski County Recorder at any future time. In the event of any violation or any attempted violation of any of the covenants or restrictions contained herein before the expiration date hereof, it shall be lawful for any person or persons owning a lot or lots subject to the provisions of this Bill of Assurance to prosecute any proceeding at law or in equity against the person or 'persons violating or attempting to violate any such covenant or restriction, and either to prevent such person or persons from so doing or to recover damages for such violation. The invalidation of any one of these covenants or:estrictions by judgment or court order shall in no wise affect any of the other pro- visions hereof, which shall remain in full force and effect. The undersigned property owners hereby contract, agree and obli- gate themselves, their successors and assigns, to comply with each of the foregoing covenants, conditions and restrictions with reference to their respective properties within a reasonable time hereafter, not to exceed two years from the date of the execution hereof. It is further understood and agreed that if any such property owner or owners shall not so comply within such period, the Housing Authority of the City of Little Rock may, at its option, proceed to enforce the rehabilitation of such properties pursuant to the provisions of the Urban Renewal Plan therefor as though such property owners had not executed this instrument.
