Jack Hartsell III, Inc. Subdivision Dear Commissioners: I represent O. Jack Hartsell III who seeks the Commission's approval of the attached proposed replat of a lot located on Beck Road in the City's extra- territorial jurisdiction. Mr. Hartsell owned a larger tract at the area of Beck Road and County Farm Road near Two Rivers Park. In June 2020, the larger tract was subdivided into the O. Jack Hartsell III Inc. subdivision of Pulaski County, Arkansas, containing two lots and a road dedication. In February 2021, the subdivision was replatted into Lot I and Lot 2R to correct a few conveyancing mistakes. In April 2021, a survey was recorded indicating that Lot 1R was split between a "house" tract consisting of the north 88 feet of Lot 1R, and a "vacant" tract consisting of the south 55 feet of Lot 1R. In August 2022, Mr. Hartsell conveyed by warranty deed the house tract of Lot 1 R to Ryan Kiernan. The remainder of the Lot 1 R was retained by Mr. Hartsell, and he desire to construct a detached, single-family home on the retained "vacant" tract. Zoning clearance was provided by the planning department and Mr. Hartsell began site work at the location in the early fall of this year. However, Planning ultimately determined that the clearance was issued in error and has 221 West Second Street, Suite 408 I Little Rock, Arkansas 72201 I Phone: (501) 222-7378 Fax: (888)711-0660 I harrison@mannkemp.com I www.mannkemp.com December 12, 2022 indicated that Mr. Hartsell is required to replat Lot 1 R if he is to complete construction of the new residence on the "vacant" tract. To that end, the attached proposal contemplates a replat of Lot 1 R into Lot IRA and Lot 1RB, with the former being the "house" tract identified on April 2021 survey and the latter being the "vacant" tract on which Mr. Hartsell desires to construct a new detached single-family home. Lot IRA is currently owned by Ryan Kiernan, who joins in this application for replat. Lot 1RB is owned by Mr. Hartsell. Because Lot 1RB is zoned R-2 and is 55 feet wide, a variance will be required from the ordinary R-2 minimum lot width of 60 feet. The variance is justified in this case because the proposed lot size and shape do not create any irregular shapes, pipestems or pockets, and the lot size is greater than the minimum lot size required for R-2. The proposed replat thus preserves the maximum density characteristics of R-2 zoning. Both Lots IRA and 1RB will be serviced by separate septic sewer systems. Both lots had successful percolation tests and both lots have been permitted by the Department of Health for the installation of septic tanks and field lines. The Department's documentation is attached. A copy of the proposed bill of assurance is also attached.
