Engineering Issues: Z-6081 Christ Temple Pentecostal Church 1200 Lewis Street All of Block 1, Sidney J. Johnson Addition C-3 A variance is requested from the area regulations of Section 36-301 to permit construction of a canopy with a reduced front yard setback. The proposed canopy is to be located over the front entrance to provide a covered drop-off area. Due to the location of the existing building, the canopy will have a reduced setback. Church Church Lewis and 13th Street have 50 foot platted rights-of-way. Dedicate 5 feet of right-of-way to bring Lewis Street and 13th Street rights-of-way to commercial street right -of --way standards. Also, the intersection of 13th and Lewis should have a 20 foot radial dedication. 12th Street is a minor arterial with 70 feet of right-of-way required. Present right-of-way is 30 feet from centerline. Dedicate 5 feet of right-of-way with the 20 foot radial dedication at the intersection with Lewis Street. Abigail Street is closed. However, the apron was never removed. Remove apron and replace curb and install connecting sidewalk on 12th Street. The turn radius at the intersection of 13th and Lewis needs improving. Current radius is less than standard of 25 feet. When additions involve increase of impervious areas greater than 500 square feet, stormwater detention analysis is January 29,. 1996 1t9i N A(Cont-) required. Sidewalks shall be repaired where tripping areas exists and handicap ramps shall be constructed in all locations per current city standards and per ordinance. B. Staff Anal i Christ Temple Pentecostal Church, located at 1200 Lewis Street, proposes to construct a canopy extending out from the front entrance of the church building. The proposed 30 foot by 30 foot canopy will cover an existing paved area which serves as the walk way from the parking lot into the church as well as an adjacent parking space reserved for the pastor. The church property is zoned C-3 which requires a front yard setback from Lewis Street of 25 feet. Due to the angle of the church entrance in relationship to the street, the proposed canopy will come to a point approximately 15 feet from the Lewis Street property line. The intrusion involves a corner of the proposed structure. The corner of the canopy will be located approximately 25 feet from the curb of Lewis Street. The proposed canopy will have no effect on either nearby properties or Lewis Street. Staff is supportive of the request. C. Staff Recommendation: Staff recommends approval of the requested front yard setback variance subject to compliance with the City Engineer's Comments. _BOARD OF ADJUSTMENT: (DECEMBER 18, 1995) The applicant was not present. There were no objectors present. Staff informed the Board that it was necessary to defer the item due to insufficient notices. A motion was made to defer the item to the January 29, 1996 Board meeting. The motion was approved by a vote of 9 ayes, 0 noes and 0 absent. BOARD OF ADJUSTMENT: (JANUARY 29, 1996) Elmer Knox was present representing the application. There were no objectors present. Staff presented the item and informed the Board that the notice requirement had been met. Staff recommended approval of the requested variance. Mr. Knox offered no additional comments. After a discussion of the engineering issues by Cindy Dawson, of the City Attorney's Office, it was determined that there was no nexus to require the dedication of right-of-way. It was also 2 January 29 19.96 I m A n determined that the comments regarding the former Abigal Street right-of-way were unrelated to this variance issue. Ms. Dawson also stated that there was currently an ordinance in place which required the applicant to repair the sidewalks and such a condition did not need to be tied to the variance. A motion was then made to approve the requested front yard setback variance subject to compliance with the City Engineer's Comments regarding the construction of handicap ramps and stormwater detention. The motion was approved by a vote of 9 ayes, 0 noes and 0 absent. 3
