Engineering z sues: Z-6066 Jeff and Vicki Shollmier #5 River Oaks Circle Lot 5, River Oaks Addition R-2 From the area regulations of Section 36-254 and the building line provisions of Section 31-12 to permit construction of an addition with a reduced side yard setback and which crosses a platted 20 foot building line. Due to an irregularly shaped lot, sloping terrain and the placement of the existing house, variances are required to accommodate the planned additions. Single -Family residence Single -Family residence There exists only 20 feet of right-of-way from centerline of street on this side of road. Platted right-of-way is 45 feet with centerline off center. Therefore the structure would be 35 feet from centerline. Due to the steep grades will the encroachment on the side yard create a problem with diverting water onto adjacent lot? Unless engineering designs are submitted to eliminate this potential, recommend denial of side yard variance. H. Staff Analysis: The applicant proposes to expand this existing, one story residence by constructing additions to the rear, side and front of the house. Due to the irregular shape of the lot and the sloping terrain, it is impractical to construct the additions in any other location. The existing house site was actually cut into the slope of the hillside. The proposed additions will encroach 4 feet into the required 8 October 30, 1995 foot side yard setback and will cross the platted front yard building line by 5 feet. The side yard setback variance requested is to allow a minor "point" intrusion at two locations. These minor intrusions should have no impact on the adjacent property. The 5 foot encroachment into the 20 foot building line also appears to be a minor issue. The structure will maintain a setback of 20+ feet from River Oaks Circle which is a short, residential cul-de-sac. This property is at a lower elevation than the adjacent property to the west which should help lessen the visual impact. If the building line variance is approved, the applicant will have to do a one lot replat to reflect the change approved by the Board. The applicant should review the filing procedure with the circuit clerk to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval of the requested side yard setback and building line variances subject to the following conditions: 1. The design of the addition is to be such that no water run-off will be diverted onto the adjacent property. 2. The existing driveway is to be removed. 3. A replat of the lot which reflects the change in the building line as approved by the Board of Adjustment. BOARD OF ADJUSTMENT (OCTOBER 30, 1995) Mark Alderfer stepped down from the Board and represented the applicant on this item. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. Mr. Alderfer stated that neither owner was able to be present and that they asked him to represent them. He stated that he understood and accepted staff's recommendation. A motion was made to approve the requested side yard setback and building line variances subject to compliance with those conditions outlined in the staff recommendation. The motion was approved by a vote of 6 ayes, 0 noes, 1 absent and 1 abstaining (Alderfer) . �a
