ROOSEVELT -- SHORT -FORM PCD (Z -6063-A) Dear Mr. Goodwin: Enclosed is a copy of the Ordinance which was passed on Tuesday, February 20, 1996, which establishes your requested PCD. Also, I have included a copy of the staff report/minute record from the Planning Commission's hearing on the PCD request. The "Planned Development" ordinance requires a development to be implemented as approved by the Planning Commission, and very little variation is permitted from the approved site plan. You are urged to keep the minute record available for future reference and to use it as a guide as you implement business programs. Any variation from the approved planned development will require a formal amendment to the PCD ordinance. Planning Zoning and Subdivision Any required changes in the site plan or submittal information must be incorporated into the document(s), and at least three (3) copies of the changed plat must be submitted to me before the file can be processed for approval. If you want a copy of the "signed -off' plan for your records, please provide an extra copy or copies beyond the three copies I need for the file. ROOSEVELT -- SHORT -FORM PCD(Z-6063-A), LOCATED AT 301 E. ROOSEVELT RD., IN THE CITY OF LITTLE ROCK, ARKANSAS, AMENDING CHAPTER 36 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That the -zone classification of the following described property be changed from C-3 to PCD. A parcel of land in Section 14, T -1-N, R -12-W, and located at 301 E. Roosevelt Rd., Little Rock, Arkansas, being more particularly described as follows: Lots 5 and 6, Block 1, Pettefer's Addition SECTION 2. ROOSEVELT -- SHORT -FORM PCD (Z -6063-A), located on the south side of E. Roosevelt Rd., at 301 E. Roosevelt Rd. None Staff initially recommended denial of the PCD, because the request included approval of an "open display" use for a used car business, a C-4 type use. Such a C-4 use is inconsistent with the character of uses allowed by the adopted Land Use Plan for the area. When the applicant refined his request, explaining that he needed the used car designation to meet state licensing requirements for a use car brokerage business, and limited both the number of used cars to be displayed and the signage on the site, the character of the use became much less intense and could be approved as being in character with the Land Use Plan. Staff subsequently has revised the recommendation to one of approval, with reservations. The Planning Commission recommended approval of the PCD with the vote of 8 ayes, 1 no, 2 absent, and 0 abstentions. The Commission voiced the analysis that the use of the site, as explained by the applicant and limited by the Commission, is, basically, in keeping with those uses allowed in the C-3 zoning district, that the "open display" use is so restricted that it does not impact the character of the use. CITIZEN On October 12, 1995, the required notification sign was posted on the PARTICIPATION property. On October 20, 1995, the required notice was sent to both the Meadowbrook Neighborhood Association and to the East of Broadway Neighborhood Association, advising them of the nature of the request and the date of the public hearing. On October 27, 1995, the required notice forms, indicating the nature of the request and the date and time of the meeting, were mailed by certified mail, to all record property owners within 200 feet of the tract. On November 14, 1995, a public hearing on the applicant's proposal to rezone the property from C-3 to C-4 was held, but, as a result of the discussion regarding the character of the proposed use, the application was amended to a PCD request and was deferred to permit the applicant to file the needed site plan and PCD documentation. On December 12, 1995, the public hearing was conducted on a revised application for a PCD request. Due to the applicant not having completed his site plan to incorporate the required information and revisions noted by the Subdivision Committee, the public hearing on the issue was again deferred. On January 30, 1995, the Planning Commission conducted another public hearing on the request. No one spoke in opposition to the request, and staff heard from no one who expressed opposition to the request. BACKGROUND The applicant proposes a mixed use planned development to include the continued use of the north (E. Roosevelt Rd.) -facing level (the upper level of a two-story building) as a grocery store; the future use of the south -facing (lower) level as a restaurant; and, the use of the five designated parking spaces at the north-west corner of the property as a lot to store used cars which he will have for sale. The applicant plans to operate a used car brokerage business, and needs a properly zoned site in order to qualify for a used car dealer's license from the State. He does not, however, plan to operate a typical used car lot and sell cars from the lot. He plans, though, to buy and sell cars at auctions and from and to individuals, and to inventory up to five cars on the property. Of the five cars, one would be permitted to have advertisement in or on it indicating that it was for sale; other cars would not. No pole sign would be allowed to advertise cars for sale; only a building sign would be permitted to advertise the applicant's used car brokerage business. BACKGROUND With these restrictions, the Planning Commission considered the use to (CONTINUED) be no more intense than any other C-3 permitted use, and recommended approval of the PCD. STAFF CANNOT SUPPORT A C-4 REQUEST AT THIS SITE, was noted. I would now like to elaborate my request with a detailed site plan to enable you reconsider this proposal and accord it a favorable processing. efer the Engingering CoMrngnts: A 70 feet dedicated right of way ROW ,exists for Roosevelt. Provision for Cumberland ROW is also made on the site plan. But you may as well remember that Cumberland did not go through from 26th street to Roosevelt. I think that the ROW for 26th street is adequate enough. The project would comply with any requirements to provide side walks on Roosevelt and 26th street. This would also include any street improvements. Traffic Engineering commence As you can see from the site plan, no provisions are made to install any parking in the ROW of any of the surrounding streets, including Roosevelt. All parking areas are paved and asphalt finish. The access to Roosevelt would be reconstructed and widened from 12 to 18 feet; to lead into the designated customer parking areas only. This access would be closed at the end where it joins the 26th street; and a NO OUTLET sign would be placed at the Roosevelt entrance. ,Staff Analysis. According to the site plan, the vehicle sale would not replace the existing grocery (food store). The proposal is: the car sale would exist along with the food store and the restaurant. 1 At this point, I would request that you place a value on the information and details contained in the site plan and give my request an adequate consideration. This would help my proposal for expansion to include; 1. A RESTAURANT at the lower floor of the existing food store. 2. A DISPLAY CAR SALE LOT at the west end of the existing food store. See site plan. 3. CUSTOMER PARKING LOTS A and B as shown on the site plan. 4. RECONSTRUCTION OF THE ACCESS TO ROOSEVELT. My proposal to develop this property would include the improvement of the following: a. the access road would close towards the 26th street, only leading cars into the customer parking areas. b. the property would be fenced (chain link) ON THE EAST, WEST AND SOUTH EDGES. C. concrete steps would be constructed to link the display car lot and the customer parking -B. This would include handicap access link d. I shall produce a composite working and detailed drawing of the RESTAURANT, THE PARKING LOTS AND THE DISPLAY CAR LOT to meet city codes and regulations. e. I would comply with any applicable improvements required. f. this proposal does not intend to make any additions or extensions to the existing building structure.
