Staff Analysis : Z-6044 Elmer Heringer 38 Lefever Lane Lot 574, Kingwood Place R-2 Variances are requested from the area regulations of Section 36-254 to permit construction of an addition with a reduced rear yard setback of 22 feet and a reduced side yard setback varying from 4 feet to 5.6 feet. The lot is unusually shaped, with angled side and rear lot lines. The house does not sit squarely on the lot. The interior layout of the existing house dictates placing the addition in this location. Single -Family residence Single -Family residence The applicant is requesting variances to allow for the construction of an addition containing a den and utility room with a reduced rear yard setback of 22 feet and a side yard setback varying from 4 to 5.6 feet. The ordinance requires a rear yard setback of 25 feet and a side yard setback of 6.5 feet for this lot. The lot is unusually shaped, with both side lot lines and the rear lot line angling in to reduce the buildable area. In addition, the house does not sit squarely on the lot. September 25, 1995 I nt. The requested year yard setback of 22 feet is only a 3 foot variance from the ordinance requirement of 25 feet. This minor variance will have no impact on adjacent properties. Due to the angle of the property line, only a small portion of the south side of the proposed addition will intrude into the required side yard setback. At the point of intrusion, the addition is well behind the adjacent house to the south. The requested side yard variance of 1 -2.5 feet should have a minimal impact on the adjacent property. Staff believes the proposal to be reasonable and supports both of the minor variance requests. C. Staff Recommendation: Staff recommends approval of the requested side and rear yard setback variances. BOARD OF ADJUSTMENT: (SEPTEMBER 25, 1995) The applicant, Elmer Heringer, was present. There were no objectors present. Staff presented the item and a recommendation of approval. Mr. Heringer offered no additional comments. A motion was made to approve the requested side and rear yard setback variances. The motion was approved by a vote of 8 ayes, 0 noes and 1 absent. Pa
