justification: Providing the new turn lane on Alamo
and obtaining the proper zoning for
this property necessitates closing
the driveway on Markham closest to
the corner. In other words, we will
have two driveways instead of three.
This makes it advisable, due to this
new configuration which is unique to
this property, to angle the canopy
and pumps toward the corner, for
better, safer circulation. Again,
this means the canopy will extend
into the Alamo Drive setback as well
as the West Markham setback, hence
this supplemental application.
However, the signs on the canopy
will still face West Markham, not
Alamo Drive, and will not be visible
driving toward Markham north on
Alamo. The new turn lane will ease
traffic back-up on Alamo Drive and
improve circulation inside the E -Z
Mart site.

soils must be certified due to underground storage tanks.

B. ataff AnalvSis:
On September 25, 1995, the Board of Adjustment approved
variances to allow for the construction of a fuel island
canopy at this existing convenience store site. At that
time, the canopy was proposed to extend straight out from
the front of the store and to cross a platted 40 foot
building line along Markham Street. Two conditions of the
approval have caused the applicant to have to change the
location of the canopy slightly. The applicant was required
to eliminate one of the two existing Markham Street
driveways and to widen Alamo Drive by 6 feet to allow for a
left turn lane.
In response to those conditions, the applicant now proposes
to angle the canopy so that it is directed more towards the
corner of the property rather than straight out towards
Markham Street. This will provide for better and safer
traffic circulation on the site. The canopy now is proposed
to cross both the Markham Street and Alamo Drive building
lines and to have a reduced front yard setback of 11.5 feet
from Markham Street and a reduced side yard setback of 5
feet from Alamo Drive. 25 foot setbacks are required by the
Ordinance in both instances.
The proposed 11.5 foot setback from Markham Street is
greater than the 5 foot setback approved in September 1995.
The canopy will, at its nearest point, be approximately. 15
feet from the curb of the widened Alamo Drive. The canopy
will have a clearance of 15.6 feet from the ground and the
support posts will be located at the pump islands. The
clearance of 15.6 feet and the 11.5 foot setback from the
Markham Street property line will preclude a sight distance
problem.
The angled canopy will be visible from the residential
neighborhood to the south. The applicant has stated that
there will be no signage on that side of the canopy visible
from the south.

Staff believes the proposal to be reasonable and supports
the requested variances.
If the building line variance is approved, the applicant
will have to do a one lot replat to reflect the change
approved by the Board. The applicant should review the
filing procedure with the circuit clerk to determine if the
replat requires a revised Bill of Assurance.
C. Staff Recommendation:
Staff recommends approval of the requested front and side
yard setback variances and the building line variances
subject to'the following conditions:
1. Compliance with the Engineering Comments
2. A replat of the lot which reflects the change in the
building line as approved by the Board.
3. There is to be no signage on that side of the canopy
visible from the residential neighborhood to the south.
BOARD OF ADJUSTMENT: (NOVEMBER 27, 1995)
Chris Barrier was present representing the application. There
were no objectors present. Staff presented the item and a
recommendation of approval, with conditions.
Mr. Barrier stated that the applicant understood and agreed to
the conditions.
A motion was made to approve the requested front and side yard
setback and building line variances subject to compliance with
those conditions outlined in the staff recommendation. The
motion was approved by a vote of 7 ayes, 0 noes, 1 absent and
1 open position.

Land which is annexed to the City is classified as R-2, si
family residential. As such, the convenience store is
nonconforming. An application has been filed with the pl
commission asking that the property be rezoned to C-3,
Commercial. The rezoning request will be heard by the Cener
Commission on October 3, 1995. The rezoning application and
this accompanying variance request are necessary to allow for
the planned remodeling of the convenience store. The
remodeling includes the addition of a second pump island and a
new, larger canopy which will extend from the building to a
point 5 feet from the West Markham Street property line.
Once the property is zoned C-3, it will have a required
front yard setback of 25 feet. Variances are requested to
allow for the new canopy to have a reduced front yard
setback of 5 feet and to allow it to be built across a
platted 40 foot building line.
The proposed canopy will have a clearance of 15.5 feet from
the ground and the support posts will he located at the pump
islands. This larger canopy, extending from the building
out over the pump islands, will replace a smaller,
freestanding canopy which is currently over the pump island
nearest Markham Street. The existing canopy has a setback
from Markham Street similar to that proposed for the new
structure. The new canopy will have no greater impact than
the existing canopy. The clearance of 15.6 feet will
preclude a sight distance problem.
Staff believes the proposal to be reasonable and supports
