Variances are requested from the
area regulations of Section 36-301
and the building line provisions of
Section 31-12 to permit
construction of a canopy with a
reduced front yard setback and
which crosses a platted 40 foot
building line.
The proposed canopy is to replace
an existing, smaller canopy with
the same setback. The canopy will
be built over existing gas pumps
which are not to be relocated as
part of the remodeling proposed for
this store.

Widen Alamo Drive 6 feet to allow left turn lane. Dedicate
additional ROW such that property line is 30 feet from
centerline, prior to dedication, clearance of underground
soils must be certified due to underground storage tanks.
Improve sidewalks to eliminate tripping areas and install
ramps at intersection. Provide additional sidewalk to
provide 3 feet clearance around telephone pole in walk.
Eliminate driveway on Markham closest to Alamo.
B. staff Analysis:
E -Z Mart Convenience Store was in existence at this location at
the time the property was annexed to the City on June 5, 1978.

Land which is annexed to the City is classified as R-2, single
family residential. As such, the convenience store is
nonconforming. An application has been filed with the Planning
commission asking that the property be rezoned to C-3, General
Commercial. The rezoning request will be heard by the
Commission on October 3, 1995. The rezoning application and
this accompanying variance request are necessary to allow for
the planned remodeling of the convenience store. The
remodeling includes the addition of a second pump island and a
new, larger canopy which will extend from the building to a
point 5 feet from the West Markham Street property line.
Once the property is zoned C-3, it will have a required
front yard setback of 25 feet. Variances are requested to
allow for the new canopy to have a reduced front yard
setback of 5 feet and to allow it to be built across a
platted 40 foot building line.
The proposed canopy will have a clearance of 15.6 feet from
the ground and the support posts will be located at the pump
islands. This larger canopy, extending from the building
out over the pump islands, will replace a smaller,
freestanding canopy which is currently over the pump island
nearest Markham Street. The existing canopy has a setback
from Markham Street similar to that proposed for the new
structure. The new canopy will have no greater impact than
the existing canopy. The clearance of 15.6 feet will
preclude a sight distance problem.
Staff believes the proposal to be reasonable and supports
the requested front yard setback and building line
variances.
If the building line variance is approved, the applicant
will have to do a one lot replat to reflect the change
approved by the Board. The applicant should review the
filing procedure with the circuit clerk to determine if the
replat requires a revised Bill of Assurance.
C. Staff Recommendation:
Staff recommends approval of the requested front yard
setback and building line variances subject to the following
conditions:
1. Compliance with the City Engineer's Comments
2. A replat of the lot which reflects the change in the
building line as approved by the Board of Adjustment.
3. The property being rezoned to C-3.

The item as moved to the end of the agenda as the applicant was
not present when the item was first called up.
The applicant was present. There were no objectors present.
Staff presented the item and a recommendation of approval, with
conditions.
The applicant offered no additional comments other than to say
that he understood and agreed with the staff recommendation.
A motion was made to approve the requested front yard setback and
building line variances subject to compliance with the three
conditions outlined in the staff recommendation. The motion was
approved by a vote of 8 ayes, 0 noes and 1 absent.
