The following description and supporting data of the above referenced project is our response to
Article VII, Section 36-456 of the Little Rock Zoning Ordinance.
The proposed development is located on the south side of Cantrell Road, adjacent to the existing
development known as "Pavilion in the Park" and directly east of Reservoir Park Road. The
property current has a single story residential dwelling and is currently zoned R-2. The proposed
re -zoning of same is a Planned Unit Development as described under Article VII of the zoning
ordinance of Little Rock.
Through the design and planning of this facility; Beverly Enterprises, Arkansas, Inc. strives to
create an environment supportive of its elderly residents. Beverly Rehabilitation and Specialty
Care Center will be a maximum three story structure with 48,000 square feet of space. There will
be 18 private rooms and 41 semi -private rooms (100 beds). The facility's design, by providing a
comfortable, safe, and home like setting will minimize the current view of Long Term Care. The
facility will feature amenities such as inviting color schemes and tasteful furnishings, large
common areas with a focus on residential living space design. Attractively decorated resident
rooms will provide a majority of the facility's spacial areas. Professional landscaped outdoor areas
will surround the structure for activities and sitting. Quality of life enhancements will be a

consideration in all aspects of the facility, from design to programmatic areas and activities. The
building will be constructed to meet or exceed all state and local licensure requirement for
construction of this type of structure.
Attached please find a complete Schematic Spacial Program which delineates the project in area.
The Administration, Rehabilitation Therapy, and Support Services areas are located on the
ground floor with direct relationship to outdoor spaces on the site. The upper floors will house
resident rooms and common living areas.
Also, attached please find our development schedule, site plan, topographical cross section of
property and proposed building elevations. These documents should provide the remaining
information listed for submission requirements under Article VII of the zoning ordinance.
We are excited about this development in the Cantrell Road corridor and will be available for any
questions you or your staff may have concerning this project.

SHORT-FORM PRD (Z -6024-A), AND LOCATED
AT 8315 CANTRELL ROAD, IN THE CITY OF
LITTLE ROCK, ARKANSAS, AMENDING CHAPTER
36 OF THE CODE OF ORDINANCES OF THE CITY
OF LITTLE ROCK; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS.
SECTION 1. That the zone classification of the
following described property be changed from R-2 to PRD.
A parcel of land in Section 26, T -2-N, R -13-W, and
located at 8315 Cantrell Rd., Little Rock, Arkansas,
being more particularly described as follows:
A part of Block 11, 1925 Subdivision of Hyland Homes
Addition, and a 15' strip of land along the E side of
Block 11, in the NE 1/4 SW 1/4 of said Section 26,
T -2-N, R -13-W, being further described as follows:
Beginning at the SW corner of said Block 11; THENCE N
01049' E along the W line of said Block 11 a distance
of 414.0' to a point on the S ROW line of Cantrell Rd.
(Arkansas State Highway #10); THENCE along the said S
ROW line the following: S 63015'23" E, 65.291; S
73033'00" E, 106.21; S 76021100" E, 100.1'; S 81051'00"
E, 104.52'; THENCE S 01049' W along a line parallel to
and 15' E of the E line of Block it a distance of

SECTION 2. That the preliminary site development
plan/plat be approved as recommended by the Little Rock
Planing Commission.
SECTION 3. That the change in zoning classification
contemplated for BEVERLY REHAB. AND SPECIALTY CARE CENTER --
SHORT-FORM PRD (Z -6024-A) is conditioned upon obtaining a
final plan approval within the time specified by Chapter 36-
454(d) of the Code of Ordinances.
SECTION 4. That the map referred to in Chapter 36
of the Code of Ordinances of the City of Little Rock,
Arkansas, and designated district map be and it is hereby
amended to the extent and in the respects necessary to
affect and designate the change provided for in Section 1
hereof.
SECTION 5. That this ORDINANCE shall take effect
and be in full force upon final approval of the plan.

WHEREAS, it is necessary for the Little Rock Sanitary Sewer

Committee and the Little Rock Wastewater Utility to repair and

replace certain sewer lines and to acquire an additional
18 easement over certain land owned by the City of Little Rock,
19 Arkansas, located near 8315 Cantrell Road within the City of
20 Little Rock, Arkansas; and
21 WHEREAS, staff has reviewed this project and has determined
22 no significant adverse impact to the park or its users; and
23 WHEREAS, compensation obtained from this sewer right-of-way
24 easement will be credited to the Adopt -A -Park Project.
25 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
26 THE CITY OF LITTLE ROCK, ARKANSAS:
27 SECTION 1. The Mayor and the City Clerk are hereby
28 authorized to execute the necessary documents to, grant a
29 right-of-way easement to the City for the use and benefit of the
30
Little Rock Sanitary Sewer Committee and the Little Rock
31 Wastewater Utility for the purpose of constructing a certain
32 sewer line on land located near 8315 Cantrell Road within the

City of Little Rock. The right-of-way easement is attached
34 i hereto identified as Exhibit "A".

SECTION 2. The City Manager is hereby authorized to

I have received the proposed Quitclaim Deed that you provided to
Mr. Hornibrook in your letter of October 4, 1995. I have two questions
with respect to the proposed deed. First, do you have a legal
description yet? We will need a legal description before the deed can
be signed. Second, what happens if the deed is executed and delivered
to you but the Board of Directors does not approve the rezoning? Is the
deed held and not recorded and then returned in that event?

rezones the Mary Couch property to "PRD" for the Beverly Rehab. and Specialty Care Center.
The site plan which you provided, as well as the engineering, landscaping, sign, etc.
requirements which were discussed, are all part of the approval, and may not be changed without
Planning Commission and Board of Directors approval.
The PRD rezoning is valid for three (3) years. During that time, a final plat of the site must have
been presented for approval and filing, and, at least, site work must have begun. Failure to take
these steps will be cause for revoking the PRD zoning. You may, if necessary, apply for and
receive an extension of time from the Planning Commission, if that should be needed.
Also, enclosed is another copy of the staff report/minute summary of the Planning Commission
hearing where the PRD was recommended for approval to the Board of Directors. All issues, at
least as far as the City is concerned, have been resolved prior to your application for a building
permit.

Staff recommends approval of the PRD.
The Planning Commission recommended approval of the PRD with the
vote of 10 ayes, 0 noes, 1 absent, and 0 abstentions.
On September 3, 1995, the required notification sign for the rezoning
request was posted on the property.
On September 15, 1995, the required notice forms, indicating the
nature of the request and the date and time of the meeting, were mailed
by certified mail, to all property owners within 200 feet of the tract.
On October 3, 1995, the Planning Commission conducted a public
hearing on the issue. No one spoke in opposition to the request, and
staff heard from no one who expressed opposition to the request.
BACKGROUND
The application was initially filed as a conventional rezoning request to
rezone the property to 0-3. At the Planning Commission hearing, the
request was amended to a PRD request, and the required site plan and
project narrative was presented. The PRD involves construction of a
48,000 square foot, three-story, 100 -bed rehabilitation and specialty
care center. The facility's design will provide a "home -like" setting with
a focus on residential living space design. The exterior will have a
residential "look" to it, and landscaping will be extensive. The applicant
proposes to comply with all Ordinance requirements concerning
dedication of right-of-way along Cantrell Rd. and consecution of off-site
road improvements.

This is in response to your letter dated October 11, 1995, and addressed to Mr. Dana Carney of
our staff. Since the office rezoning has been converted to a planned development application, I
will be taking the request forward to the City Board of Directors.
In rezonings and planned developments, when a right-of-way dedication is required and a means
of dedicating the right-of-way is needed, the simplest means of accomplishing this is the
Quitclaim Deed. In straight rezonings, this is generally used, since a plat is not normally
involved. In planned developments, though, since a site plan is the basic exhibit, the means
chosen by the developer to dedicate right-of-way is by a plat. If the property is going to be
platted, then the right-of-way can be dedicated as part of this process. The planned development
would only take effect when this condition, among others, is met. The developer, then, can
make the determination as to how the dedication is to be accomplished.
As to your questions....
The engineer preparing the site plan/survey would be the one who would furnish a legal
description of the land to be dedicated. If the Quitclaim Deed is chosen as the means of
dedicating the required right-of-way, that engineer needs to be contacted for the legal description
of that land.
If a Quitclaim Deed is executed by the property owner, but the City Board of Directors fails to
rezone the property, in this case fails to establish the "planned development", then the Quitclaim
