The first phase, as hidicated on the accompanying site plan, will consist of a five -story, 150,000 square foot, office building and approximately 450 parking spaces. As indicated on the overall site plan a city street of 60' lt_O.W. and 36' paved area is proposed to divide the property into north and south sections. It is envisioned that Arkansas Systems or related properties will develop the north section of the property for office buildings of their use, The south section will be for future developme- a.t by others. It is proposed that the city street be built eastward, as needed, to serve the main parking areas, private drive, and the secondary entrance .farther to the east. A private drive will be constructed that will connect the city street to the main parking area entrance and to the secondary entrance to the north. The First Phase access and egress will be from Clrenal Parkway. Building services and screened trash areas will be located near the .northeast -comer of the building. Nine handicapped parking spaces will be located near the west (main) entrance to the building. A .masonry wall with building name and address is being planned at the northeast corner of the intersection of the private drive and new city street. Landscaping in excess of city ordinances is being planned for the first phase parking and perimeter areas. In addition the west shoreline of the existing five acre lake will be groomed and landscaped to allow for views and access to the waters edge. Attached is a copy of the Design Data for the building to be located in the first phase of this project. The site is located on the east side of Chenal Parkway, approximately 1 / 2 mile north of the west Kanis Rd. intersection None Staff recommends APPROVAL of the DEFERRAL from the requirement to provide on-site stormwater detention with the First phase of development. On June 24, 1995, the required notice forms, indicating the nature of the request and the date and time of the meeting, were mailed by certified mail, to all property owners within 200 feet of the subdivision. On August 8, 1995, the Planning Commission conducted a public hearing on the Site Plan Review. No one spoke in opposition to the proposed development, and staff heard from no one who expressed opposition to the request. This item was heard by the Planning Commission prior to instructions for the Commission to have a specific vote on variances accompanying a rezoning or planned development request. The vote to approve the site plan, in light of the discussion held by the Commissioners, can, possibly, be construed to also be a vote to recommend approve of the variances which were requested and which were discussed by the Commission. BACKGROUND The Arkansas Systems Corporate Office Park involves development, as an initial phase, of Lot 1 in a 5 -lot subdivision for the Arkansas Systems offices. The 5 -lot subdivision involves construction of an east -west public collector street which bisects the site, and improvements to two lakes on the site. The lakes are to be part of the on-site stormwater detention facilities. The larger lake, the one which abuts the Arkansas Systems offices, will involve reconstruction of the earthen dam. The route of the east -west public collector street carries the roadway across the dam. The public collector street is proposed to be constructed to the east boundary of Arkansas System site at this time, stopping it short of the lake. With the development of Lots 3, 4, or 5, the east -west public collector street will have to be constructed. This will entail reconstruction of the dam across the northern -most lake. The on-site stormwater detention facilities, then, are proposed to be provided in a subsequent phase which involves development of any of these three lots. The applicant seeks to defer the dam improvements until a subsequent phase involving the three lots which abut or are down stream from the lake, and leave the existing dam and lake "as is" for this initial phase of construction. The length of the private drive with the phase I construction is approximately 870 feet long. Public Works, citing the requirements of Secions 31-210 and 31-287, is requiring the private drive meet the design standards of a public collector street. (The design must meet the centerline profile and horizontal layout of a public street, and must have sidewalks along both sides of the drive.) The applicant points out that the drive is to provide internal vehicle circulation, with the length of the drive being limited, and that design of the drives to meet the criteria for public street traffic speeds is not desired. The applicant also points out that an internal pedestrian circulation system is to be provided, and that sidewalks along the internal drives are not needed. A variance from the requirements of Sec. 31-210 is sought by the applicant. ORDINANCE NO. AN ORDINANCE AMENDING CHAPTER 31 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, PROVIDING FOR A VARIANCE FROM THE REQUIREMENT THAT THE INTERNAL PRIVATE DRIVE MEET PUBLIC COLLECTOR STREET DESIGN STANDARDS AND HAVE SIDEWALKS ALONG BOTH SIDES OF THE DRIVE, FOR ARKANSAS SYSTEMS OFFICE CORPORATE OFFICE PARR (Z-6015), LOCATED ON THE EAST SIDE OF CHENAL PARKWAY, APPROXIMATELY ONE-HALF MILE NORTH OF THE WEST KAKIS ROAD INTERSECTION, LITTLE ROCK, ARKANSAS. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. That Chapter 31 of the Code of Ordinances be amended to provide for a VARIANCE from certain requirements within the Subdivision Regulations of the City of Little Rock for ARKANSAS SYSTEMS CORPORATE OFFICE PARK (Z-6015), and located on the east side of Chenal Parkway, approximately one-half mile north of the west Kanis Road intersection: Subsection a: That, pursuant to Sections 31-210 and 31-287, a VARIANCE be approved from the provision that, when a commercial or office development requires the creation of an internalized vehicle circulation system to provide access to multiple lots and building sites, the internalized vehicle circulation system be built to public street design standards, and permit the horizontal and vertical alignment of the drive as shown on the site plan proposed by the developer and as approved by the Planning Commission. Subsection b: That, pursuant to Sect. 31-287, a VARIANCE be approved from the provision that the internalized circulation system be built to public street design standards, and permit the provision by the developer of an alternate internalized pedestrian circulation system in lieu of the required sidewalks along the internalized vehicle circulation system. SECTION a. This ORDINANCE shall take effect thirty (30) days from and after its passage. (a) The purpose of this division is to set forth procedures for processing site plans and to estab. lish standards for development within those dis- tricts which require compliance with this division. (6) Site plan review is a development review process that provides for case by case consider- ation of project particulars including the provi- sion of parking and landscaping, siting of build- ings and the compatibility of the proposed development with adjacent uses. (c) All development shall be designed in such a was as to minimize any potential deleterious im- pact on the surrounding area. Special attention shall be given to buffering multifamily, commer- cial and industrial developments from adjacent single-family areas. Design of the internal street system, ingress and egress, ori -street parking, load- ing and pedestrian ways shall be sensitise to such conditions as safety, convenience, separation of vehicular and pedestrian traffic, general attrac- tiveness, areas of dwelling units and the proper relationship of different land uses. Landsc�ed areas shall be provided to reduce erosion, heat and glare and said areas shall be maintained in an attractive condition. Existing trees on a devel• opment site shall be retained where possible. Screen- ing, open space or other buffer may be required to give adequate separation between uses which are not compatible and shall also be provided for the beautification and enhancement of the property. The requirements of Arkansas State Fire Code, section 50S, providing for handicapped parking and accessibility shall be indicated on the plan. (a) The procedure for the zoning of property to one (1) of the classifications listed in -section 36-127 shall be the same as for any other zoning applica. tion. The planning commission may outline spe- cial parameters or special concerns which will apply to the site plan when such are identified through the zoning process. (b) The site plan review process occurs when a building permit is requested. The city department having planning responsibility and authority, the subdivision committee and the planning commis. sion shall review site plans prior to the issuance of a building permit. At that time, the plan Kill be assessed for compatibility with standards and cri- teria provided herein. Public review of a site plan proposal shall take place at regularly scheduled monthly meetings at which time interested per- sons may appear and offer information in support of or against the proposed site plan. The city de- partment having planning responsibility and au- thority and the subdivision committee will make recommendations to the full- planning commis- sion at the public hearing and the commission will then either approve the site plan as sub- mitted, approve the site plan with modifications, defer the site plan for future review, or deny the site plan. (c) In addition to the special requirements of this section, the planning commission may im- pose on a site plan such additional requirements as are necessary to safeguard the public health, safety and general welfare. The planning com- mission may require the applicant to submit a revised site plan incorporating the imposed re- quirements and modifications. Such revised site plans shall have priority over new applications in the rev- e -x process. The planning commission may Supp. No. I I 136-130 deny a site plan and recommend reducing the zoning classification of any parcel which is re- quired a site plan if it does not carry out the general purpose of this division. In those instances where a variance from district standards is re- quested as a part of the submittal request, the planning commission may modify or waive stand- ards. A variance may be allowed only after dem- onstration of a hardship unique to the develop- ment proposal filed. Pecuniary difficulties shall not be deemed to constitute a hardship. (Code 1961, Ch. 43, § 4.103(c); Ord. No. 15,247, § 1, 2.17-57; Ord. 1\o. 15,958, § 4, 12-1S-90) Sec. 36-129. Initiation. Any application for a zoning classification which involves site plan review nay be initiated by the owner or other person having a contractual inter- est in the property for which site plan approval is requested or by the authorized agent of such owner or person. (Code 1961, Ch. 43, § 4-103(d)) Sec. 36-130. Submission requirements. (a) Zoning submission. The submission re- quirements for the rezoning of any lot, parcel or tract of land which includes site plan review shall be the same as for any other zoning application to the city. If available, a general graphic represen- tation of what is proposed may be submitted show- ing the following: (1) Approximate location of buildings. -- (2) Approximate location of parking. (3) Approximate location of landscaping. (4) Approximate location of ingress and egress. (b) Site plan submission. The submission require- ments for the review of a site plan preceding the receipt of the building permit shall include the following: 2305 (1) A site plan to be submitted on white paper no larger than twenty-four (24) inches by thin _v -six (36) inches, and no smaller than twelve (12) inches by twenty-four (24) inch- es, and including: § 36130 LITTLE ROCK CODE a. Schematic landscape plan showing pro- posed treatment of the areas designated as either buffers or private common open space. f. Location and dimension of all existing and -proposed utility and street ease- ments and all existing public improve- ments within the site. g. Proposed location of structures and struc- tural dimensions, dimension distances between buildings, and distances from structures to property lines. (2) A topographical cross-section map of the site. (3) Quantitative data including the following information: a. Proposed building coverage of princi- pal and accessory buildings. b. Parcel size. C. Proposed floor area of principal and accessory buildings. d. Proposed number of parking spaces. (4) A registered land sur. ey showing the exact property or boundary lines, including a legal description of the total site proposed for development, including a statement of present and proposed ownership. (5) In addition to the graphic and supporting documentation required for filing, the owner shall proNide a graphic or narrative 5u pp. No. 11 outline of methods to be employed to pro- tect permanent undisturbed buffers. The outline/plan shall be filed for re%iew by the planning commission not later than the filing date set by calendar. (Code 1961, Ch. 43, § 4-103(e); Ord. No. 16,116, § 1(j), 11-19-91) Sec. 36-131. Standards for site plan dis- approval. The planning commission shall not disapprove an application for a site plan except on the basis of findings directed to one (1) or more specified particular of the following standards: (1) The proposed site plan is incomplete or con- tains or reveals violations of this chapter or applicable district regulations which the applicant has, after written request, failed or refused to supply or correct. (2) The proposed site plan does not comply with the minimum screening and landscaping requirements of the city. (3) The proposed site plan interferes unneces- sarily with easements, roadways, rail lines, utilities, and other public or private rights- of-way. (4) The proposed pedestrian and vehicular cir- culation systems incorporated in the site plan subsequently create hazards to safety on or off the site. (5) The proposed site plan does not conform to the minimum drainage requirements found in chapter 31. (6) The proposed site plan violates the basic intent of this chapter- or does not comply with those conditions which were stipulated at the time of rezoning. 1% (Code 1961, Ch. 43, § 4.103(f); Ord. 'To. 16,249, § 1,2-17-87) Sec. 36-132. Effect of approval. (a) An approved site plan shall be binding on the applicants and their successors and assignees. (b) No building permit shall be issued for any building or structure not in conformance with the 2306 Subd-11 SITE PLAN REVIEW CRITERIA ZONING, SUBDIVISION, CONDITIONAL USE, VARIANCE OR P.U.D. The following list is the minimum criteria for submittal of a Site Plan Review issue, whether for Planning Commission or Board of Adjustment approval. This information shall be included in all submittals on or before the docket closing date for the issue involved. It may be necessary for individual development applicants to contact either the City Engineer or the utility companies for purposes of determining this information. a. All permanent buildings and structures proposed or existing with dimensions on the buildings and setbacks from property lines. b. All parking areas, whether existing or proposed, and the radius on all drive lanes, curves or turns. C. All points of ingress or egress to the site from adjacent streets or properties and dimensions of drives. d. All drives and streets intersecting all boundary streets across from the site are to be indicated and properly dimensioned. e. Availability of public utilities, indicating the line size and location. f. All on-site fire hydrants, both existing and proposed. g. All on-site water systems, both existing and proposed. h. All property lines with dimensions. Existing right-of-way dimensions on abutting streets and all street names clearly delineated. j. Areas within the development site to be devoted to landscaping. k. Provide the required number of handicap parking spaces. The above material being a minimum criteria for submittal will be viewed as necessary in order to review an application. There are a few items missing from the boundary survey requirements of the Preliminary Plat, a copy is available. 2. Right-of-way dedication for Gooch Lane should be 50 feet versus 45 feet, the length of the roadway appears to exceed minor residential length. This street also is not a cul-de-sac or short loop street. Minimum horizontal radius for street shall be 150 feet, unless a waiver is sought from the Board of Directors. Dedication of right-of-way should follow this minimum horizontal radius. 3. Widen the roadway to residential standards to gain access to this new subdivision. Otherwise, seek a waiver of from the Board of Directors. Reference section 31-201(f). A sidewalk will be required on frontage. 4. Open ditches are generally not permitted by the Stormwater Management and Drainage Manual, if ditches are planned, they must be shown on the preliminary plat and be approved by the City Engineer prior to Planning Commission approval, reference Section 31-89(9) of the LR Code. Show any planned drainage ditches on preliminary plat. Show water courses entering and planned exit points for drainage. Planned Developments Z-4343-1 Saddle Creek Retail Center NE Corner of Chenonceau and Ranch Drive 1. Sketch plan information including floodplain information should be provided prior to Planning Commission action. APDC&E approval along with a proper grading and excavation permit before any work is planned. 2. Widen entrance on Chenonceau to 36 feet. 3. Construct sidewalks on both streets. Submit plans for construction of Ranch Drive to collector street standards. 4. Provide drainage easement for large drainageway on the North boundary. Recommend that the structures be held 25 feet minimum from the limits of the water surface. The design and construction of this open drainage for the flow of 3500 cfs will require approval. The ditch may require concrete lining or other erosion protection. Recommend that this large ditch be fenced for the protection of the public. 5. Stormwater detention analysis will be required. The approved drainage system for Chenonceau Boulevard does not allow for this site to discharge drainage over the curb or into the inlets on Chenonceau Boulevard. Discharge from site will be directly into the North drainage ditch. 6. The entrance drives should have adjacent sidewalks connecting to the public sidewalks. Z -4563-A Community Bakery 12th and Main Street 1. Traffic Engineering advises the following: a. Revise parking to incorporate total access to parking spaces within the lot. The attached standards from the Traffic Engineering Handbook should be utilized. All parking spaces shall only be accessed through the parking lot. (i.e. no perpendicular parking in alley). b. No compact car spaces, all spaces shall be built to be used by all vehicles. 2. Sidewalks and ramps shall be improved west of alley. 3. Alley apron shall be constructed to conform to City of Little Rock standards. Site Plan Reviews Z-6015 Arkansas Systems Lot 2, Arkansas Systems Park 1. The proposed location has 3 areas of boundary that require improvements per the Master Street Plan and City Ordinances. Chenal Parkway intersection plan at the unnamed collector that traverses this property is attached. The unnamed Collector and Kirk Road both require 60 foot right-of-way and 36 foot pavement with sidewalks on both sides. Chenal Parkway will require sidewalks on frontage. 2. The intersection shown on the submitted plan is located only 200 feet from the collector's intersection with Chenal. This spacing does not meet the required minimum spacing requirement of 600 feet as specified in Section 31-285 of the Little Rock Code of Ordinances. This proposed street will provide major access to a multi -office complex, thus generating large peak hour volumes causing the intersection as designed to fail. The intersection should be moved to the east a minimum of 200 feet and preferably 400 feet to provide ample left turn storage and weaving section to access the development. Another option would be to extend the median island to restrict left turn movements from the unnamed collector. The intersection should be within 15° of a 900 intersection. The private street should be 36 feet in width and have sidewalks on both sides. The private street should not connect two public streets and be limited to short loop or cul-de-sac alignments where the development served contains less than 5 acres, per Section 31-207.b(2). 3. Stormwater detention will be required for site. Open ditches are generally not permitted by the Stormwater Management and Drainage Manual, if ditches are planned, they must be shown on the plan and be approved by the City Engineer prior to Planning Commission approval. 4. The location of the unnamed collector is recommended to be moved South of the dam. Public liability for the dam would be required if the dam is a part of the public right-of-way. The dam construction shall be certified by a geotechnical engineer with experience in dam construction. 5 A sketch plan identifying the floodplain and floodway is required before Planning Commission action. Base flood elevations are required. Dedication of floodway is required. a grading and excavation plan and permit are required. A Development permit is required. Contact USACE-LRD for approval prior to start of work. All drainage structures for the floodway including the spillway of dam shall be designed for the 100 year storm.
