Site Location: FILE NO.: Z -6014-A Immanuel Baptist Church - Revised Conditional Use Permit 18020 Cantrell Road, NW Corner of Intersection with Patrick County Road Immanuel Baptist Church/ John Gerlach To amend an existing Conditional Use Permit at 18020 Cantrell Road to allow up to four temporary modular buildings to be installed on this R-2, single Family Residential, zoned property. Buildings are to be used for educational purposes. This site is located on the North side of Cantrell Road just west of "The Ranch" development, just inside the city limit boundary at the Northwest corner of the intersection with Patrick County Road. 2. CoMatibility with Neighborhood: This site is zoned R-2, Single Family Residential. It currently has facilities for the church consisting of a white membrane building for the main sanctuary, and an older house used for meeting and education purposes. The new temporary buildings would be to the northwest of the house towards the rear of the area currently developed. The site is surrounded by a mixture of zoning. To the east is zoned 0-2 and contains "The Ranch" multi -use commercial and office development. To the north is R-2, Single Family Residential. To the west is a small Planned Commercial Development containing office, commercial, and residential. To the south across Cantrell is R-2 lightly developed Single Family Residential. The use is an acceptable activity in this zoning as a conditional use and is compatible with the mixed December 3, 1998 SUBDIVISION ITEM NO • 13 (Cont,) FILE NO.: Z -6014-A development occurring in this area. Staff believes the style of the temporary facilities, while not preferred in a final development of the area, would not have a large adverse impact as temporary facilities. The Aberdeen Court and Johnson Ranch Neighborhood Associations were notified of the public hearing. 3. On -Site Drives and Parkin : Sufficient access is provided by two driveways, one 36 foot wide from Cantrell and one 22 foot wide from Patrick County Road. Street improvements along both roads have been deferred in the original Condition Use permit until Phase II Construction. However, improvements to Patrick County Road must start by August 15, 2000. Current primary assembly area seating capacity is two hundred and fifty. That would require sixty-two parking spaces. There were seventy-four provided in Phase I so parking requirements are met. 4. Screening and Buffers: No new requirements beyond those required in original Conditional Use Permit. 5. Public Works Comments: No additional requirements or issues. All original Conditional Use Permit conditions are still required according to original time schedules. 6. Utility and Fare Department Comments: Water: On site fire protection may be required. Contact the Water Works if additional or larger meter(s) are required. Wastewater: Sewer available, not adversely affected. Southwestern Bell: Approved as submitted. ARKLA: No comments received. Entergy: No Comments received. Fire Department: Notify and coordinate with the Fire Department on placement of fire hydrants. CATA: This site is served by CATA Express Route #25 (Highway 10). Staff Analysis: In August 1995 a Conditional Use Permit was approved for this site for a 5400 square foot membrane structure, use of the existing house, and a new paved parking lot for at least sixty-three (63) spaces. The applicant is now requesting a revised conditional use permit for the placement of up to four (4) temporary modular buildings for educational use. The buildings would be one story on a raised concrete block foundation with an enclosed crawl space. They would be made of wood or metal and be built to meet standard building codes. They will be all electric with no water or sewer connections. The site is in the Highway 10 Overlay District and conforms to the one hundred foot setback and forty -foot buffer requirements. The buildings will be used for children and adult educational space accommodating approximately thirty people per building. Each building would be thirty feet by forty- five feet and provide a total of approximately 5,400 square feet. The four (4) new buildings will be used temporarily at this location for approximately five (5) years until such time as the Church growth justifies the beginning of the development/construction of permanent facilities, which make up Phase II. View of these temporary buildings will be partially obstructed from Cantrell by the house and membrane buildings. View from the west will be partially obstructed by trees. Staff believes this is a reasonable interim step but that this should be the only interim step. Any further development should be permanent and include all the normal required site and road improvements that were included in the original Conditional Use Permit and current ordinance requirements. 8. Staff Recommendation: Staff recommends approval of the revised conditional use permit subject to the following conditions: 1. Coordinate closely with the fire department on placement, separation, and construction standards of these buildings to meet fire protection standards. 2. Limit the temporary use to five (5) years. At the end of five (5) years from the date of this action, if Phase II construction has not begun, come back to the Commission for review and determination regarding status 3 December 3, 1998 SUBDIVISION ITEM NO.: 13 (Cont.) SUBDIVISION COMMITTEE COMMENT: (NOVEMBER 5, 1998) Pat McGetrick was present representing the applicant. Staff gave a brief description of the proposal. The applicant was reminded of the requirement to screen the dumpster, which had been placed on the property. They agreed to remedy that. There being no further issues, the Committee accepted the proposal and forwarded the item to the full Commission for final resolution. PLANNING COMMISSION ACTION: (DECEMBER 3, 1998) Pastor John Gerlach, Steve Elliot, and Pat McGetrick were present representing the application. There were no objectors present. Staff presented the item with a recommendation for approval of the proposal, continued deferral, and variance, subject to compliance with the conditions listed under "Staff Recommendation." The item was placed on the Consent Agenda and approved as recommended by staff. The vote was 7 ayes, 0 nays, and 4 absent. 4
