Staff Analysis: Z-6008 August Brown/Billy Hartness, Agent #11 Bayonne Court Lot 1, Block 32, Chenal valley Addition R-2 variances are requested from the building line provisions of Section 31-12 and the area regulations of Section 36-254 to permit construction of a single family residence which crosses a platted 25 foot building line by one foot and which has a reduced side yard setback of 7.5 feet. Due to the obtuse angle of the property lines, the builder inadvertently constructed the house so that the front of the structure crosses the building line and one corner comes to within 7.5 feet of the side property line. The error was not noticed until the structure was complete and an "as built" survey was done. _ Single -Family residence Single -Family residence On January 5, 1995, a building permit was obtained for this single family residential structure. Due to the obtuse angles of the property lines, the builder inadvertently constructed the house so that the front of the house crosses a platted 25 foot building line by one foot and one corner of the residence intrudes 6 inches into a required 8 foot June 26, 1995 item 7(Cont.) side yard setback. The error was not noticed until the structure was complete and an "as built" survey was done. The building line error involves only one foot of a small portion of the front of the structure. The 6 inch side yard intrusion affects only a corner of the residence. Neither encroachment is noticeable and approval of the requested variances should have no impact on the neighboring properties. If the building line variance is approved, the applicant will have to do a one lot replat to reflect the change approved by the Board. The applicant should review the filing procedure with the circuit clerk to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval variance and the building of the lot which reflects approved by the Board of BOARD OF ADJUSTMENT: of the requested side yard setback line variance subject to a replat the change in the building line as Adjustment. (JUNE 26, 1995) Bill Hartness was present representing the application. There were no objectors present. Staff presented the item and a recommendation of approval with one condition. Mr. Hartness offered no additional comments. A motion was made to approve the requested side yard setback variance and the building line variance subject to a replat of the lot which reflects the change in the building line as approved by the Board of Adjustment. The motion was approved by a vote of 6 ayes, 0 noes and 3 absent. E
