variances are requested from the
building line provisions of Section
31-12 and the area regulations of
Section 36-254 to permit
construction of a single family
residence which crosses a platted
25 foot building line by one foot
and which has a reduced side yard
setback of 7.5 feet.
Due to the obtuse angle of the
property lines, the builder
inadvertently constructed the house
so that the front of the structure
crosses the building line and one
corner comes to within 7.5 feet of
the side property line. The error
was not noticed until the structure
was complete and an "as built"
survey was done. _

Single -Family residence
On January 5, 1995, a building permit was obtained for this
single family residential structure. Due to the obtuse
angles of the property lines, the builder inadvertently
constructed the house so that the front of the house crosses
a platted 25 foot building line by one foot and one corner
of the residence intrudes 6 inches into a required 8 foot

side yard setback. The error was not noticed until the
structure was complete and an "as built" survey was done.
The building line error involves only one foot of a small
portion of the front of the structure. The 6 inch side yard
intrusion affects only a corner of the residence. Neither
encroachment is noticeable and approval of the requested
variances should have no impact on the neighboring
properties.
If the building line variance is approved, the applicant
will have to do a one lot replat to reflect the change
approved by the Board. The applicant should review the
filing procedure with the circuit clerk to determine if the
replat requires a revised Bill of Assurance.
