Engineering Issues: Z-5997 Leslie and Shara Turk 41 Avignon Court Lot 7, Block 17, Chenal Valley Addition R-2 A variance is requested from the building line provisions of Section 31-12 to permit construction of a single family residence which crosses a platted 20 foot building line by 6.4 feet. Due to the curvature of the property line on the Avignon Court side, the builder inadvertently constructed the house so that one corner crosses the building line. The error was not noticed until the structure was complete and an "as -built" survey was done. Single -Family residence Single -Family residence Survey submitted has incorrect floodplain information. Staff Analysis: On June 28, 1994, a building permit was obtained for this single family residential structure. Due to the curvature of the property line on Avignon Court, the builder inadvertently constructed the house so that one corner of the structure crosses the 20 foot building line by approximately 6.4 feet. The error was not noticed until the structure was complete and an "as built" survey was done. June 26, 1995 Ttem N 2 C n The intrusion involves only a corner of the structure and should not have an impact on any neighboring properties. At this point, Avignon Court curves around this property. The street itself is broader in this area, with a landscaped island separating this property from those on the south side of Avignon Court. Staff believes the requested variance will have no impact on neighboring properties and is supportive of the request. If the variance is approved, the applicant will have to do a one lot replat to reflect the change approved by the Board. The applicant should review the filing procedure with the circuit clerk to determine if the replat requires a revised Bill of Assurance. C. Staff Recommendation: Staff recommends approval of the requested building line variance subject to a replat of the lot which reflects the change approved by the Board of Adjustment. BOARD OF ADJUSTMENT: (JUNE 26, 1995) The applicant, Les Turk, was present. There were no objectors present. Staff presented the item and a recommendation of approval, with one condition. Mr. Turk offered no additional comments. A motion was made to approve the requested building line variance subject to a replat of the lot which reflects the change approved by the Board of Adjustment. The motion was approved by a vote of 6 ayes, 0 noes and 3 absent. Fa
