A variance is requested from the
area regulations of Section 36-254
to permit construction of an
addition with a reduced rear yard
setback of 16.4 feet. The
Ordinance requires a rear yard
setback of 25 feet in the R-2
district.
The existing house was constructed
with a front yard setback of 48.4
feet, much greater than the typical
25 feet for single-family homes in
the City. The large front setback
limits the available rear yard.

The applicant proposes to construct a master bedroom suite
addition onto the rear of this existing residence. The
addition will have a reduced rear yard setback of 16.4 feet.
The Ordinance requires a 25 foot rear yard setback in the R-
2 district. Due to the excessive front yard setback of 48.4
feet, the buildable area of the rear yard is reduced. This
minor, 8.6 foot, encroachment into the rear yard setback
should not have an impact on any adjacent properties. There
will still be adequate separation from the residence to the
rear which fronts onto Rockwood Road.

BOARD OF ADJUSTMENT: (APRIL 24, 1995)
Lou Ellen Eberle was present representing the applicant. There
were no objectors present. Staff presented the item and a
recommendation of approval.
John Borchert informed the City Attorney present that he was a
partner with the applicant in an unrelated issue and questioned
whether he should abstain on the item. Steve Giles, Deputy City
Attorney, asked Mr. Borchert if he had a monetary or vested
interest in this matter or if his association with the applicant
would sway his vote on the item. Mr. Borchert responded no to
both questions. Mr. Giles advised him that there was no need to
abstain.
Mrs. Eberle offered no additional comments.
A motion was made to approve the requested rear yard setback
variance. The motion was approved with a vote of 7 ayes, 0 noes,
1 absent and 1 abstaining (Alderfer).
