City Engineer's Comments are as follow:
Construct half street improvements to collector standard on
Mabelvale Pike. Access to Mabelvale Pike shall be taken
from the existing joint access drive. Arkansas Highway and
Transportation Department must approve any driveway plans
and construction on South University Avenue. Stormwater
detention analysis is required.

On April 18, 1995, the Planning Commission voted to
recommend approval of a request to rezone this property from
C-3 to C-4. On May 16, 1995, the Board of Directors passed
an Ordinance rezoning the property to C-4. Throughout the
rezoning process, it was clear that the stated use for the
property would be a used car sales lot.
Prior to rezoning, the site was relatively small to begin
with, being an average of 167.5 feet deep. Through the
rezoning process, the applicant was required to dedicate
additional right-of-way for Mabelvale Pike. The resulting
property averages 140 feet in depth.
The development criteria of the C-4 zoning district states
that there shall be no open display of any kind whatsoever
in the first 20 feet of the required front yard setback.
Once the required building setbacks and landscaped areas are
provided, there is very little display area left available
on this small site.
It would appear that there is some justification
in allowing vehicle display within the front 20
feet of the setback. In addition to the required
6 foot wide landscape strip, there is some 45 feet
of grassy right-of-way between the property line
and the edge of the South University Avenue
pavement. This broad, grassy right-of-way
contributes to the appearance of a greater vehicle
setback from the traffic on South University.
The reduced display setback would not appear to be _
out of character with other development on South -
University. This street is literally lined with
vehicle sales businesses, both new and used, which
have vehicle display areas located as the
applicant proposes.
Staff is supportive of the requested variance.
C. Staff Recommendation:
Staff recommends approval of the requested variance to
permit the display of vehicles for sale within the first
20 feet of the required front yard setback subject to the
following conditions:
1. Compliance with the City Engineer's Comments
2. Compliance with the City's Landscape Ordinance
