Engineering Issues: Z-5971 Curtis and Shellat Lockheart 1616 Charlotte Dr. Lot 166, Broadmoor North R-2 From the building line provisions of Section 31-12 to permit a carport to cross a platted building line. The garage has been enclosed and the carport will use the existing driveway. This is the only feasible location for the carport. Single -Family Single -Family There are none to be reported. B. Staff Anal sis: 1616 Charlotte is a corner lot and there is a 25 foot platted building line on the two street sides. The request is to allow a carport to be attached to the front of the house and across the building line. The Charlotte Street side of the residence is built to the 25 foot line. Therefore, the entire carport will be beyond the platted building line. The proposed size of the carport is 17 feet by 18 feet. Originally, 1616 Charlotte had a garage, but a previous owner enclosed the space and left the house without any covered area for vehicles. The current owners would like to add the carport to protect their vehicles from the elements and a large tree which is located next to the existing driveway. Another concern that the owners hope the carport corrects is a water problem that is occurring where the garage was enclosed. There is no overhang and the windows that were added are leaking and the wood is starting to rot. April 24, 1995 Item No., D Cont. Allowing the carport to be attached to the house should help remedy this costly problem. This is the only reasonable location on the lot because of the existing driveway and the front entrance to the house. An open carport will not have an adverse impact on the nearby properties. The carport will have a setback of 18 feet from the edge of the street so there should not be any visibility problem. (Should the Board of Adjustment approve the variance, the owner will also have to do a one lot replat to modify the building line. The owner needs to check the bill of assurance to make sure that a carport structure does not violate the private restrictions for the subdivision.) C. Staff Recommendation: Staff recommends approval of the building line variance for an open carport. BOARD OF ADJUTMENT: (MARCH 27, 1995) The applicant was not present. There were no objectors present. The item was moved to the end of the meeting in hopes that the applicant would appear. Staff presented the item and informed the Board that a neighbor had called and stated that the sign had been placed on the property 3 days prior to the meeting, not 10 days as required by the Bylaws. Staff noted that all other notice requirements had been met. In light of the applicant's failure to appear and the question about the placement of the sign on the property, a motion was made to defer the item to the April 24, 1995 Board meeting. The vote was 9 ayes, 0 noes and 0 absent. BOARD OF AD TMENT: (APRIL 24, 1995) The applicant, Shellat Lockhart, was present. There were no objectors present. Staff presented the item and a recommendation of approval. Staff informed the Board that the sign had been on the property since before the March 27, 1995 Board meeting. Mrs. Lockhart offered no additional comments. A motion was made to approve the building line variance for the proposed open carport. The motion was approved with a vote of 8 ayes, 0 noes and 1 absent. 2
