WHEREAS, Ordinance No. 16,908 was passed on June 20, 1995 establishing a planned zoning district; and WHEREAS, the owner of the subject property has requested the repeal of a portion of the "PZD" ordinance for 220 acres of the original 695 acres zoned "PRD" - Planned Residential District; and WHEREAS, the owner of the subject property has requested that the zoning of the property be reclassified to 11R-2" Single Family Residential District. (Z -5963-B) FISCAL IMPACT RECOMMENDATION CITIZEN PARTICIPATION BACKGROUND Action Required Ordinance Resolution Approval Information Report Submitted By Cy Carney City Manager The property owner, Elgor, Inc., through their agent (Rocket Properties) requests that a portion of the Brodie Creek — Long -Form PRD be officially revoked and the property revert to R-2 zoning as originally existed. None The Planning Commission approved the PRD partial revocation, as recommended by staff, with a vote of 7 ayes, 0 nays, 3 absent and 1 open position. The Planning Commission reviewed the PRD partial revocation at its May 31, 2001 meeting. There were no objectors present. The John Barrow and Spring Valley Manor Neighborhood Associations were notified of the public hearing. On June 20, 1995, the Board of Directors passed Ordinances No. 16,908 and 16,910, rezoning 695 acres from R-2/1\4F- 12/MF-18/0-2/0-3/C-1 to PRD establishing the conceptual plan for "Brodie Creek — A Community of Four Neighborhoods" and the Brodie Creek Community, East Neighborhood — Amended Long -Form PRD (first phase of development). The approved concept was for a "Traditional Neighborhood Development" patterned after 18" and 19" century villages which were designed to foster neighborliness and a sense of community. The PRD site encompasses 695 BACKGROUND acres, and was designed to have four (4) distinct CONTINUED neighborhoods. To date, Phase I (The East Neighborhood) has been partially developed, with some single family residences currently under construction. Each neighborhood was to be unique, and to be defined by a green edge and village center. The entire PRD development was to contain approximately 1,100 home sites, with potential for 55,000 square feet of commercial and up to 160,000 square feet of office/service space. The approved plan also included common recreational space (2 lakes, pond, streams and pocket parks). PROPOSAL: The property owner, Elgor, Inc., through their agent (Rocket Properties) requests that a portion of the original PRD be officially revoked and the property revert to R-2 zoning. The portion of the original PRD proposed to be revoked amounts to 220 acres immediately west of Phase I, as shown on the attached sketch. The property owner proposes to revoke this area from the PRD so that a preliminary plat for a more conventional single family residential subdivision can be filed in the near future on an upcoming Planning Commission agenda. The majority of the 220 acres proposed for revocation was previously zoned R-2. However, there are two (2) small areas which were zoned multifamily (W-12 and W-18). The applicant wishes for these areas to be zoned R-2 as well. The ordinance which staff prepares for the PRD revocation will be tailored to include the down -zoning of these two (2) multifamily areas. ORDINANCE NO. Also, I have secured an option on an additional 150 acres owned by Elgor. These properties, along with other land owned by Elgor, are currently zoned PRD and are known as Brodie Creek. Our development team is currently working on plans to develop this land into a single-family residential neighborhood. Therefore, we are seeking changes to the current zoning of this property on the portions that we have under contract and have optioned. We are requesting: 1. An amendment to the existing PRD to exclude the land we propose to purchase. 2. The rezoning of this land to R-2 Elgor, Inc. has authorized us to pursue these changes as noted in the attached letter. Also, I have attached a property description of the land that is to be amended and rezoned and a map showing the area to be amended and rezoned in relation to the current PRD.
