Public Works Issues: Z -5958-A Arkansas Taekwondo Association 12615 Chenal Parkway Part of the East 1/2, NE 1/4, Section 5, T -1-N, R -13-W C-3 A variance is requested from the height regulations of Section 36- 301 to permit construction of an office building with a height of 65 feet. The configuration of the property, when coupled with the required street improvements and zoning setbacks, makes it necessary to construct a multi-level building. vacant, undeveloped site Three story, 40,000 square foot office building A Sketch Grading and Drainage Plan per Sec. 29-186(e) and A Grading Permit per Sec. 29-186(c) and (d) are required. Provide striping and signage plans for the development, for Traffic Engineering approval. Stormwater detention ordinance applies to this property. Sidewalks shall conform to Sec. 31-175. Right-of-way is required to 30 foot from centerline for Markham Street. Chenal Parkway requires 50 feet of right-of-way with an additional 10 foot sidewalk and utility easement. Plans of all work in right-of-way shall be submitted for approval prior to start of work. Construct 1/2 collector improvements for Markham Street with sidewalk. A waiver of Master Street Plan intersection design for Chenal will need to be approved by the Board of Directors. February 24, 1997 Item No.: 1 Cont. B. Staff Analysis: Bank of the Ozarks proposes to construct a new office building on the vacant, C-3 zoned lot located at 12615 Chenal Parkway (intersection of Chenal Parkway and West Markham). The bank's proposed building is to be three stories in height with below grade level parking. At its highest point on the roof, the building will be approximately 50 feet above grade. The building will have a total of approximately 40,000 square feet which includes a banking lobby, corporate offices and approximately 10,500 square feet of available lease/expansion space. The C-3 district height regulations limit building heights to 35 feet. Building height is defined as "the vertical distance as measure through the central axis of the building from the elevation of the lowest finished floor level to the ... mean height level between the eaves and ridge of a gable, hip or gambrel roof." Including the below grade parking, the proposed building will have a height of 65 feet. On March 27, 1995, the Board of Adjustment approved a variance to allow the American Taekwondo Association to build a 4 -story, 48,000 square foot building on this site. The variance was to allow for a building height of 88 feet, measured from the finished floor elevation at the basement. The building proposed at that time had setbacks of 60 feet from Chenal Parkway, 50 feet from West Markham, 155 feet from the intersection and 130 feet from the west property line. It was felt that the enhanced setbacks, well beyond those required in the C-3 district, mitigated the increased building height and lessened its impact on adjacent properties. The project was never developed. The building currently proposed will have approximate setbacks of 80 feet from Chenal Parkway, 70 feet from West Markham, 180 feet from the intersection and 75 feet from the west property line. Again, staff feels that the enhanced setbacks will mitigate the impact of the increased building height. The wide setbacks and existing rights-of-way will help minimize the visual effect of the proposed building on surrounding properties. The building's design and the increased landscaping proposed at the intersection should create an attractive addition to the parkway corridor. C. Staff Recommendation: Staff recommends approval of the requested height variance subject to the following conditions: 1. Compliance with the Chenal Design Overlay District guidelines BOARD OF ADJUSTMENT: (FEBRUARY 24, 1997) Jimmy Moses and Rick Redden were present representing the application. There were no objectors present. Staff presented the item and a recommendation of approval, with conditions. Mr. Moses stated that he understood and had no problem with staff's recommendation. In response to a request from Brandon Rogers, Mr. Redden presented a rendering showing the proposed building. A motion was made to approve the requested height variance subject to compliance with the conditions outlined in the staff recommendation. The motion was approved by a vote of 7 ayes, 0 noes, 1 absent and 1 open position. 3
