Engineering Issues: Z-5952 Betty Shells 1115 Schiller Street South 20 feet of Lot half of Lot 5, Block Wolfe's Addition R-3 4 and the North 18, Marshall and From the area regulations of Section 36-255 to permit construction of an open carport addition with a reduced front yard setback of 12 feet. A front yard setback of 25 feet is required in the R-3 district. The property currently has no carport or garage. Tree limbs, large hickory nuts and other debris fall on the applicant's vehicle, scratching the paint. The applicant's 92 year old mother lives with her and needs a sheltered entrance to the house from the car. Staff Analysis: The applicant proposes to construct an open carport addition onto this existing single family residence. The proposed carport will have a reduced front yard setback of 12 feet. The Ordinance requires a front yard setback of 25 feet in the R-3 district. February 27, 1995 No__ 3 (C The effect of the reduced front yard setback is mitigated somewhat by the fact that Schiller Street has a 60 foot right-of-way, 10 feet more than is required by the Master Street Plan. This puts further separation between the residences which front onto Schiller Street and reduces the visual impact of the proposed carport. The proposed carport is to be unenclosed with the only solid wall being at the point the carport is joined to the existing house. The proposed carport will be built over the existing, paved driveway. Staff feels that the proposal is reasonable and should have no impact on the adjacent properties. C. Staff Recommendation: Staff recommends approval of the requested front yard setback variance subject to the carport not being enclosed on any side other than at the point it is connected to the existing house. BOARD OF ADJUSTMENT: (FEBRUARY 27, 1995) The applicant was not present. There were no objectors present. Staff presented the item and a recommendation of approval subject to the carport not being enclosed on any side other than at the point it is connected to the existing house. At this point, the item was moved to the end of the agenda in hopes that the applicant might arrive. When the item was brought back up, Dana Carney, of the Planning Staff, informed the Board that Ms. Shells had called him and stated that she had just brought her elderly mother home from the hospital that day. As such, she was unsure if she could make it to the meeting. After a brief discussion, a motion was made to approve the requested front yard setback variance subject to the condition that the carport is not to be enclosed on any side other than at it point it is connected to the existing house. The vote was 8 ayes, 0 noes, 0 absent and 1 open position. 2
