Taylor Street Lot 5, Block 21, Mountain Park Addition R-2 From the area regulations of Section 36-254 to permit construction of an addition with a reduced side yard setback of 1.3 feet. The Ordinance requires a side yard setback of 5 feet in the R-2 district for a 50 foot wide lot. Currently, the rear 10 feet of the house is a poorly constructed, uninsulated slant roof addition. The applicant proposes to completely rebuild this area and expand an additional 9 feet. In order to maintain continuity with the rest of this existing house, a variance is necessary. The applicant proposes to completely rebuild this area and add an additional 9 feet. The proposed remodeling and addition will maintain the existing roof line of the house. The house currently has a side yard setback on the "P" Street side of 1.3 feet. A side yard setback of 5 feet is required in the R-2 district for a 50 foot wide lot. January 30, 1995 Item No.: 3 (Cont.)_ "P" Street is a narrow, chip -sealed street located within a 50 foot right-of-way. The house is actually located approximately 20 feet from the edge of the street itself, giving the appearance of a greater setback than 1.3 feet. The proposed addition will not be out of character with the neighborhood which contains several other homes which also have reduced setbacks from the narrow, substandard streets. Staff believes the proposal is reasonable and supports the side yard setback variance. C. Staff Recommendation: Staff recommends approval of the requested side yard variance. BOARD OF ADJUSTMENT: (JANUARY 30, 1995) The applicant, Paul Bert, was present. There were no objectors present. Staff presented the item and a recommendation of approval. Mr. Bert offered no additional comments. A motion was made to approve the requested side yard setback variance. The motion was approved by a vote of 6 ayes, 0 noes, 2 absent and 1 open position. PA
