If disturbed area is 1 or more acres, obtain a NPDES storm water permit from the Arkansas Department of Environmental Quality prior to the start of construction. Acknowledged 2. Repair or replace any curb and gutter or sidewalk that is damaged in the public right-of-way prior to occupancy. Acknowledged 3. On site striping and signage plans should be forwarded to Public Works, Traffic Engineering for approval with the site development package. We will forward the Striping Plan (Sheet C-4) and the Site Plan with Signage (Sheet C-3) to Public Works, Traffic Engineering. 4. Submit a Traffic Impact Study for the proposed project. Study should address trip generation and trip distribution for the development and also should take into account existing and projected traffic growth. Peters and Associates will submit the study. 5. Damage to public and private property due to hauling operations or operation of construction related equipment from a nearby construction site shall be repaired by the responsible party prior to issuance of a certificate of occupancy. Acknowledged 6. Prior to construction of retaining walls, a engineer's certification of design and plans must be submitted to Public Works for approval. After construction, an as -built certification is required for construction of the retaining wall. We will forward the sealed structural sheets (SW1.0, SW1.1) for the retaining wall to Public Works for approval prior to construction and an as -built certification after completion of the wall. 7. Access to and from the site is shown to be taken through parking aisles with vehicle backing into the access creating vehicle conflicts. An access easement without vehicles backing into the easement should be provided. The access is what was delineated on the original Master Site Plan. ITEM NO.: 3. Z -5936-K NAME: McDonald's at the Promenade Zoning Site Plan Review LOCATION: located at 17601 Chenal Parkway Planning Staff Comments: 1. Provide notification of property owners located within 200 -feet of the site, complete with the certified abstract list, notice form with affidavit executed and proof of mailing. The notice must be mailed no later than November 2, 2011. The Office of Planning and Development must receive the proof of notice no later than November 10,2011 . Property Owners were notified on 11/1/2011 by certified mail. The affidavit and proof of mailing was e-mailed to the Planning Dept. on 11/1/2011. 2. The site plan indicates the placement of 45 parking spaces. The ordinance would typically require the placement of 43 parking spaces. There are 45 parking spaces on site with access and parking easements providing additional spaces. 3. Provide details of any proposed ground and building signage. The ground signage should indicate the location of the sign, the total height and total sign area. Provide details building signage including location and total percentage of the facade area to be covered with signage. Final design of the Monument Sign has not been finalized but the sign will be a maximum of 8' in height with a maximum of 50 square foot faces on each side. The area of the Chenal Parkway facade is 2,229 square feet. The McDonald's fascia sign is 41.24 sf. The Arch sign is 14 sf. The Welcome sign is 2.64 sf Total Sign area is 58 square feet or 2.6% of the fagade area. 4. Provide the days and hours of operation. 24 hours a day, seven days a week. 5. Provide the maximum building height proposed for the structure. The top of the parapet is 20'-0". The height of the tallest building element (the roof cap element) is 23'-4". 6. Per the DOD the site lighting is to be low level and directional, directed downward and into the site. The DOD requires all utilities to be underground. Acknowledged 7. If the drives are not platted access easements then the perimeter landscape strip must be a minimum of 9 -feet. All drives have recorded access and parking easements. See Sections 3.1 and 3.2 of the Declaration of Reciprocal Easements, Covenants and Restrictions. 8. The dumpster cannot be located on Chenal Parkway. Relocate the dumpster away from the street. The Trash Corral has been relocated away from Chenal Parkway on the east side of the property. VariancelWaivers: None requested. Public Works Conditions: 1. With site development, provide design of street conforming to the Master Street Plan. Construct street improvement to the street with the planned development. Acknowledged 2. A concrete apron should be provided at the intersection of the access easement and Oak Meadow Drive per City Ordinance. Not Applicable 3. Repair or replace any curb and gutter or sidewalk that is damaged in the public right-of- way prior to occupancy. Acknowledged 4. Plans of all work in right-of-way shall be submitted for approval prior to start of work. Obtain barricade permit prior to doing any work in the right-of-way from Traffic Engineering at (501) 379-1805 (Travis Herbner). Acknowledged 5. Hammerheads should be designed to be at least 80 feet in length and the same width as the street. Acknowledged 6. A grading permit in accordance with Section 29-186 (c) and (d) will be required prior to any land clearing or grading activities at the site. Other than residential subdivisions, site grading and drainage plans must be submitted and approved prior to the start of construction. Acknowledged 7. Stormwater detention ordinance applies to this property. Show the proposed location for stormwater detention facilities on the plan. Stormwater detention was determined and planned for the overall development. The Outparcel surface drains with the exception of the roof drains which are piped to an existing off -property storm drain manhole shown on the Utility Plan (See Sheet C-8.0). 8. If disturbed area is one (1) or more acres, obtain a NPDES stormwater permit from the Arkansas Department of Environmental Quality prior to the start of construction. Acknowledged 9. Streetlights are required by Section 31-403 of the Little Rock code. Provide plans for approval to Traffic Engineering. Streetlights must be installed prior to platting/certificate of occupancy. NOW, THEREFORE, Developer, for and in consideration of the benefits to accrue to it, its successors and assigns, which benefits it acknowledges to be of value, has caused to be made a plat, showing a survey made by Paul M. White, Registered Land Surveyor, dated August 2007, and bearing a Certificate of Final Approval executed by the Planning Commission of the City of Little Rock, Arkansas, and showing the boundaries and dimensions of the Property now being subdivided into lots (the "Plat"), being a replat of Lot 1, Tract 5, Chenal Valley, an Addition to the City of Little Rock, Pulaski County, Arkansas. There is shown on said Plat that certain non-exclusive "15' Utility, Drainage & Swlk. Esmt." (the "Easement") for drainage and/or utilities, which Developer hereby donates and dedicates to and for the use of public utilities, the same being, without limiting the generality of the foregoing, electric power, gas, telephone, water, sewer and cable television with the right hereby granted to the persons, firms or corporations engaged in the supplying of such utilities to use and occupy such Easement, and to have free ingress and egress therefrom for the installation, maintenance, repair and replacement of such utility services and related equipment within such Easement, all in accordance with and subject to the provisions hereof. The lands embraced in the Plat shall be forever known as "Lot I R and Lots 2 - 9, Tract 5, Chenal Valley, an Addition to the City of Little Rock, Arkansas," and any and every deed of conveyance of any lot in The Promenade at Chenal Parkway describing the same by the number shown on said Plat shall always be deemed a sufficient description thereof Said lands herein platted and any interest therein shall be held, owned and conveyed subject to and in conformity with the following: 1. Setback Requirerrtents. All buildings built on any lot shall comply with the setback restrictions imposed upon the lot in the Plat. 2. Easements for Public Utilities and Drainage. A non-exclusive Easement, as described herein, for the installation, maintenance, repair and replacement of utility services, sewer and drainage, which has heretofore been donated and dedicated, a more specific depiction of which is shown on the Plat tiled herewith. Notwithstanding anything to the contrary herein, the Easement and the use thereof by any person or entity entitled to the use thereof pursuant to the Plat and this Bill of Assurance (each a "Permittee') shall be subject to all of the following conditions: (i) Developer and the owner of the portion of any lot within the Easement shall have the right to maintain therein, without limitation, landscaping, retaining walls, fences, monument signage and other improvements that do not unreasonably interfere with the use, maintenance or operation of the Easement or the improvements therein by any Permittee as contemplated and permitted under this Bill of Assurance, and in no event may Developer construct any building within the Easement; (ii) in the event the use of the Easement as contemplated and permitted herein requires any Permittee to remove or otherwise disturb any landscaping or improvements in the Easement, then prior to commencing such work Permittee shall give Developer written notice of the contemplated date on which Permittee intends to commence such work, and following completion of such work such Permittee shall, at its sole cost and expense, repair and restore (or cause to be repaired and restored) the portion of the Easement and the improvements therein removed or otherwise disturbed as a result of such work to the condition existing immediately prior to such use; (iii) all utility lines and related improvements and equipment in the Easement shall be located below grade, unless otherwise approved in writing by Developer and the owner of the lot on which any above -grade improvements or equipment are proposed to be located (each in the exercise of its sole and absolute discretion) prior to the installation thereof; (iv) all work performed by any Permittee pursuant to this Bill of Assurance shall be performed in a good and workmanlike manner, shall be diligently prosecuted and completed in the least practical period of time reasonably necessary to perform such work, and shall be performed in a manner so as to minimize, to the extent reasonably practical, any interference with the operation of the Shopping Center, and (v) each Permittee hereby agrees to and shall indemnify, defend, and hold Developer and its affiliates, owners, members, managers, partners, directors, officers, agents and employees harmless from and against any and all "Losses" (as defined below) which arise from or are in any way connected with any or all of the following (collectively, the "Permittee Indemnified Matters"): (a) the exercise by any Permittee or its officers, directors, members, partners, subtenants, invitees, agents, employees, contractors or representatives (collectively, "Permittee Parties") of any rights or obligations under this Bill of Assurance, including without limitation all construction and related activities and the use and operation of any improvements located in the Easement and installed and/or utilized by such Permittee or its Permittee Parties; (b) any act, omission or negligence of any Permittee or its Permittee Parties; (c) any violation or alleged violation by any Permittee or its Permittee Parities of any law, code, ordinance or other governmental regulation; (d) any breach or default on the part of any Permittee in the performance of any covenant or obligation contained in this Bill of Assurance; and (e) claims for work or labor performed for or materials supplied or furnished to any Permittee and/or its Permittee Parties. In case any action or proceeding is brought against any or all of Developer or its affiliates, owners, members, managers, partners, directors, officers, agents and employees by reason of any of Permittee's Indemnified Matters, Permittee, upon notice from Developer shall defend such action or proceeding by counsel reasonably satisfactory to, or selected by, Developer. For purposes of this Article, the term "Losses" shall mean all claims, demands, expenses, actions, judgrnents, damages, penalties, fines, liabilities, losses of every kind and nature, suits, administrative proceedings, costs and fees, including, without limitation, attorneys' and consultants' reasonable fees and expenses, and the costs of cleanup, remediation, removal and restoration, that are in any way related to any matter covered by the foregoing obligations. 3. Property Lines and Boundaries.
