Staff Analysis: Z-5932 Ken and Donna Jameson 20 Hearthside Drive Lot 27, Overlook Park R-2 The request is filed under the building line provisions of Section 31-12 to permit construction of a swimming pool and deck which will cross a platted 25 foot building line. Due to the slope of the property and the applicant's desire to tie a new patio to the existing patio, this location is the only one appropriate for the placement of the pool. The lot has frontage on two streets with a 25 foot building line along the rear property line. This greatly reduces the amount of buildable area available. Single-family residential Single-family residential with swimming pool The applicants propose to construct a swimming pool in the rear yard of this residential property. A portion of the pool and the wood deck adjacent to it will cross a platted 25 foot building line which extends along the rear property line. The property is a double frontage lot with the front of the home facing Hearthside Drive and the rear fronting onto Timberlake Drive. The 25 foot building line on the December 27, 1994 Item No.: 8 (Cont. Timberlake Drive frontage, combined with the slope of the property and the existing home, limits the available building area on the site. The applicants desire to extend an existing patio by adding a new concrete patio which will wrap around the south side of the pool: Due to the slope of the property, the concrete patio will transition into a wood deck which wraps around the north side of the pool. At its highest point, the deck will be 3 to 4 feet above grade. The wood decking will be skirted with lattice panels. Several of the homes on Hearthside Drive which back up to Timberlake Drive have privacy fences along their rear property lines. The construction of this pool and deck will have a minimal visual impact on adjacent properties. Staff feels that the request is reasonable and supports the variance. If the building line variance is approved, the applicant should file a one lot replat and an amended Bill of Assurance to reflect the change in the building line. C. Staff Recommendation: Staff recommends approval of the requested building line variance. BOARD OF ADJUSTMENT: (DECEMBER 27, 1994) The applicant, Ken Jameson, was present. There were no objectors present. Staff presented the item and a recommendation of approval. Mr. Jameson offered no additional comments. A motion was made to approve the requested building line variance. The motion was approved by a vote of 7 ayes, 0 noes, 1 absent and 1 open position. 2
