Engineering Issues: Z-5924 Jarrett Property Management, Incorporated; Holcombe Heights Apartments 2100 Rebsamen Park Road Part of the SW 1/4, SE 1/4, Section 29, T -2-N, R -12-W R-6 A variance is requested from the area regulations of Section 36-260 to permit construction of a deck and a building containing a fitness room and hospitality room with a reduced side yard setback of 0 feet. The ordinance requires a side yard setback of 25 feet. Due to the extreme slope of the property and the limited buildable area, this location is the only one available for the proposed construction. Placing the structures here will allow them to be tied in to the existing swimming pool area. Apartment complex consisting of 18 buildings containing 125 units on 6.06 acres. Same, with the addition of a fitness room and hospitality room The drive is a private drive and should be brought to minimum residential street standards as required by Little Rock Code Section 31.207. The name of the drive is Treetops Drive not Hilltop Drive, as indicated on the survey. f December 27, 1994 Item No.: 4 Cont. B. Staff Analysis: Holcombe Heights Apartment complex was constructed in 1964. Because it is one of the oldest apartment complexes in the city, Holcombe Heights does not have some of the amenities that the more recently constructed apartment complexes have. In order to be more competitive with these newer developments and provide the amenities for its residents, Holcombe Heights would like to construct a two-story building containing an exercise room on the first floor and a hospitality room on the second floor. A deck is also proposed to be constructed adjacent to this building. Due to the extreme slope of the property and the existence of the apartment buildings and parking lots, there is very little buildable area available. The applicant desires to locate this proposed new building in close proximity to the complex's swimming pool. Locating the building in this area will result in a side yard setback of 0 feet. The ordinance requires a side yard setback in the R-6 zone of 25 feet. The Rivercliff Apartment complex is located on the adjacent property to the south. The Rivercliff property is at a substantially lower grade than the Holcombe Heights property. The steep hillside between the two complexes is heavily wooded which will act as a buffer between the fitness/hospitality building and the Rivercliff development. Staff feels that the proposal is reasonable and supports the requested side yard setback variance. C. Staff Recommendation: Staff recommends approval of the requested side yard setback variance subject to the following conditions: 1. No portion of the roof overhang may extend beyond the property line. 2. The applicant must install rain gutters on the proposed new building to prevent water run-off onto the adjacent property. BOARD OF ADJUSTMENT: (DECEMBER 27, 1994) The applicant, Emery Jarrett, was present. There were no objectors present. Staff presented the item and a recommendation of approval. Mr. Jarrett offered no additional comments. A motion was made to approve the requested side yard setback variance subject to the following conditions: 2 J ' December 27, 1994 Item No.: 4 (Cont.) 1. The motion was approved by a vote of 7 ayes, 0 noes, 1 absent and 1 open position. .K7
