The request is filed under the
provisions of Section 31-12(c) to
permit construction of a swimming
pool and spa which will cross a
platted 40 foot building line. The
pool will have a setback from
Hinson Road of approximately 12
feet.
The 40 foot platted building line
along Hinson Road almost completely
encompasses the entire rear yard of
the property, greatly reducing the
amount of buildable area available.

The applicant proposes to construct a 19 foot by 33 foot
swimming pool and spa in the rear yard of this property.
The rear of this lot fronts onto Hinson Road. The 40 foot
building line along the Hinson Road frontage nearly
encompasses the entire rear yard. In order for the
applicant to construct any structure in the rear yard of his
property, a variance to cross the building line is required.
The rear of the house is pushed to the 40 foot building
line, leaving no other available space to build the pool
without obtaining a variance to cross the building line.

The proposed pool will have a setback of approximately
12 feet from the Hinson Road property line and is hidden
from the street by a 6 foot opaque fence.
Staff feels that the variance is justified and supports the
requested variance.
If the building line variance is approved, the applicant
will need to file a one lot replat and an amended Bill of
Assurance to reflect the change in the building line.
C. Staff Recommendation:
Staff recommends approval of the requested building line
variance.
BOARD OF ADJUSTMENT: (NOVEMBER 28, 1994)
Buddy Gregg was present representing the applicant. There were
no objectors present. Staff presented the item and a
recommendation of approval. Mr. Gregg offered no additional
comments.
A motion was made to grant the requested building line variance.
The motion was approved by a vote of 8 ayes, 0 noes and 1 open
position.
