14 WHEREAS, the Board of Directors passed cej-tain standards for landscaping and
15 buffering of wireless communication facilities (the "W(*'F") in Little Rock, Ark., Ordinance
16 No. 18,173 (December 20, 199), as may be amended ("I .RO 18,173 "), which wee: e to apply
17 to all future applications for WCF permits, and
18 WHEREAS, Section 2(c)(6) included a requires hent that WCFs in existence on the
19 date of the ordinance, but not in compliance with the provisions of the ordinance, were
20 required to come into compliance within a two year peri A of time unless the Board granted
21 a waiver, or a deferral, of the various provisions, and
22 WHEREAS, Crick6t Communications has applied for waivers of five site;; it desires
23 to co -locate its facilities on towers which were in existe ice when LRO 18,173 was passed,
24 and
25 WHEREAS, as set forth below, the Board believf:s the requests are appropriate under
26 the current circumstances.
27 NOW, THEREFORE, BE IT ORDAINED BSTHE BOARD OF DIR EXTORS
28 OF THE CITY OF LITTLE ROCK, ARKANSAS:
I SECTION 1. The following WCF permits are granted waivers of strict
2 compliance with the landscaping or screening and buffs ring provisions, or both :is set forth
3 below, of LRO 18,173, as follows:
4 (A) 8352 Cantrell Road. Because this site is within Reservoir Park and the
5 current TeleCorp WCF tower on which C ricket intends to co -•locate is located
6 deep in the park with natural vegetation surrounding it on three sides, the
7 following waiver from strict compliance with LRO 18,173, tinder the current
8 circumstances, is granted:
9 (1) Landscaping requirements on all four sides of the structure are
10 waived.
11 This waiver is permitted because the curre rit circumstances acre that the site is
12 within the Jackson Reservoir Municipal '.Vater Works site, within Reservoir
13 Park, and it is within a heavily wooded area not bounded or proximate to
14 residential uses. For these reasons, strict compliance with LRO 18,173 is
15 waived until such time as a major change in circumstances make it necessary
16 to impose landscaping or screening requirements in order to meet the goals set
17 forth in the ordinance.
18 (B) No. 3 Trigon Place. Because the I'VCF tower at this location is within
19 an area zoned I-2, Light Industrial, and is located in the parking lot next to an
20 office building, the following waiver from Arict compliance with LRO 18,173,
21 under the current circumstances, is grantecl:
22 (1) -Landscaping requirements (n all four sides of the structure are
23 waived.
24 For this reason, strict compliance with LRI_) 18,173 is waived until such time
25 as a major change in circumstances make it necessary to impose landscaping
26 or screening requirements in order to meet ]he goals set forth in the ordinance.

I (C) 3319 Mabelvale Pike. Because the WCF tower at this location is
2 zoned I-2, Light Industrial and is surrounded by industrial and commercial
3 uses, the following waiver from strict corn. pliance with LRO 18,173, under the
4 current circumstances, is granted:
5 I (1) Landscaping requirements .)n all four sides of the structure are
6 waived.
7 For this reason, strict compliance with LIZ 0 18,173 is waived until such time
8 as a major change in circumstances make it necessary to impose landscaping
9 requirements in order to meet the goals sc:.,t forth in the ordinance.
10 (D) 4021 West 8th Street. Because thc: current 300 -foot lattice -style tower
11 located on this property is within a pa: -king lot of the Snyder Building
12 surrounded by a commercial building, dri veway and parking; area and zoned
13 PCD, Planned Commercial Developmeni, the following waiver from strict
14 compliance with LRO 18,173 under the current circumstances is granted:
15 (1) Landscaping requirements ()n all four sides of the structure are
16 waived.
17 For these reasons, strict compliance with LRO 18,173 is waived until such
18 time as a major change in circumstances make it necessary to impose
19 landscaping requirements in order to meet 1:he goals set forth in the ordinance.
20 (E) 724 Chester Street. Because this WCF tower is currently located in
21 property zoned I-2, Light Industrial, and Js surrounded by industrial zoning
22 containing a =Mixture of commercial and industrial uses, waivers from strict
23 compliance with LRO 18,173, under the current circumstances, are granted.
24 (1) Landscaping requirements on all four sides of the WCF tower
25 site are waived;
26 (2) Screening requirements on a 1 four sides of the 'NCF tower site
27 are waived;

1 (3) Setback variances for the re; i.r and side yard to accommodate the
2 additional equipment being placed on this co-located facility. The rear
3 setback (west) is varied from 25 fe ,,A to 3 feet; the side: setback (north)
4 is varied from 15 feet to 6.29 feet.
5 For these reasons, strict compliance witt LRO 18,173 is waived until such
6 time as a major change in circumstan,::es make it necessary to impose
7 landscaping or screening requirements in order to meet the goals set forth in
8 this ordinance. Variances are granted For the rear and side setbacks to
9 accommodate the additional ground equipment to be placed on the site.
10 Section 1. Findings.
11 (A) The Board declares that the general landscapii i g and screening provisions of LRO
12 18,173 should be met whenever possible, particularly in residential areas, but that strict
13 compliance for WCF tower permits granted prior to the effective date LRO 18,173 is not
14 always appropriate under existing circumstances. For ..-xample, it may not be possible to
15 purchase or lease additional property around the existing '{WCF site to meet the landscape and
16 buffer requirements. Or, while the applicant is willing tc fulfill the City's skated preference
17 of tower collocation, it is unable to do so and meet la idscaping requirements because a
18 particular WCF tower is located in an area that, regard less of its zoning classification, is
19 really commercial or industrial in nature, and not only would landscaping be o-i minimal
20 value, it might in fact draw attention to the tower locati. ►n and invite theft, vandalism, and
21 be in derogation of the goals and purposes of LRO 18,1 T3.
22 (B) Under such circumstances, and others.not ; let forth herein, it is appropriate to
23 grant waivers from the strict requirements of LRO 18,173, provided that if in the, future a
24 major change in circumstances occurs, the City may ii:.odify the waivers grante,d to any
25 subsection of this ordinance in accordance with Subsect ion (C) below.
26 (C) For purposes of this ordinance, "a major change in circumstance" means that
27 the area within 200 feet of the boundaries of the WCF tower site has developed to the point

I that there is a virtually unobstructed view of the tower fr( )m any adjoining residences located
2 in an area zoned R-1, R-2, or R-3, and
3 (1) (a) The City has received a com plaint from the owner
4 of such a residence located vithin 200 feet of the
5 tower site that the site has no landscaping or
6 screening in place; and
7 (b) The City has requested that i he parties resolve the
8 issue by agreeing to cixtain screening or
9 landscaping requirements consistent with LRO
10 18,173, which can be grante I administratively by
11 the Director of Planning and Development, but no
12 agreement has been reaches.
13 Once a year, for any matters impacted by this provision, i he Board will receive a report from
14 the Department of Planning and Development, to be mad,-, a part of the Board records on file
15 with the City Clerk, which identifies the tower sites tha. have previously received waivers
16 but, pursuant to this provision or any similar applicable I)rovisions, has been the subject of
17 modifications. In addition, these modifications shall lie noted on the City's g;ographic
18 information system map; OR
19 (2) The tower site permittee has leased suffa..;ient additional spice to meet the
20 landscaping setback, setback and screening requirements :)r LRO 18,173, subject to any right
21 of review set forth in that ordinance, as may be amender !.
22 (D) Pursuant to the provisions of subsection (C:) above, before any modification of
23 a waiver is required, the City shall demonstrate that a in Jor change in circumstances from
24 the date of the original permit grant, or from the date of ai i.y waiver or deferral, has occurred.
25 Section 3. Severability. In the event any section, subsection, subdivision, paragraph,
26 item, sentence, clause, phrase, or word of this ordinance is; declared or adjudged to be invalid
27 or unconstitutional, such declaration or adjudication shal I not affect the remaining portions

I of the ordinance which shall remain in full force and e: fect as if the portion so declared or
2 adjudged invalid or unconstitutional was not originally a part of the ordinance.
3 Section 4. Repealer. All laws, ordinances, resol .rtions, or parts of the same, that are
4 inconsistent with the provisions of this ordinance are hrreby repealed to the extent of such
5 incons stency.
6 Section 5. Emergency. The City appreciate the : act that the federal government has
7 taken steps to encourage the advancement of telecommunications technology, and
8 understands that it is incumbent upon the City to encourage additional carriers to enter into
9 the telecommunications field and to be able to have son i e certainty about the requirements
10 and conditions for tower permits within the City. Such development is essential to protect
11 the public health, safety and welfare. An emergency is, tlierefore, declared to exist, and this
12 ordinance shall be in full force and effect from and after the date of its pas:'age.

SYNOPSIS
'phis request comes to the Board asking for a waiver of the
landscaping and wood fence screening requirements, plus a
setback variance for an existing Wireless Communication
Facility located at 724 Chester Street due to the site being
surrounded by industrial zoning containing a mixture of
commercial and industrial uses. The property is zoned I-2,
Light Industrial.

PARTICIPATION
BACKGROUND
Cricket Communication, the newest cell phone service
provider in this area, has started their system build -out to
provide service in the Little Rock Area. Their plan is to
collocate where ever possible. Cricket is proposing to
collocate at a 140 foot height on this existing 150 foot Alltel
WCF, and add equipment cabinets which are 12.5 feet long by
2.5 feet wide on the ground within the existing fenced area.
This existing site is located behind commercial buildings
located on the southwest corner of 7t` and Chester Streets. The
Board of Adjustment approved the original WCF in November
1994 with a 150 foot height.
BACKGROUND
CONTINUED
A used car lot abuts the site to the south and southeast, a
commercial building abuts the site to. the north and northeast,
and gravel parking areas exist to the east, west and northwest.
The existing site is in the northwest corner of the parent
property. Therefore, the applicant does not have room within
the parent property for landscaping on the north and west, and
feels that it would be impractical and of little benefit to
landscape the east and south sides based on the nature of the
location and surrounding uses.
The original approved WCF included variances for rear and
side setbacks. New setback variances would be required for
the additional equipment. The ordinance requires 25 feet rear
and 15 feet side setbacks. The plan shows only 3 feet to the
rear or west, and 6.29 feet on the north side. In order to be able
to maneuver within the leased area, the applicant feels the
equipment needs to be located as requested. In September a
new ordinance will go into effect which will eliminate those
setback requirements. However, since they are requesting
approval before the effective date of the new ordinance, a
variance is required. Based on their space requirements, a
desire to leave room for another collocator, and the pending
ordinance change, they felt the variance would be justified.
The applicant is requesting this setback variance be granted
along with the requested waivers. No change to the tower
height is proposed.
The applicant is also asking for a waiver of the wood fence
screening because of the nature and location of the site. A
wood fence would make the site more visible at ground level
and create a possible security problem because police patrols
passing the area would no longer be able to see inside the
fenced area. Being able to see inside the fenced area is
considered important in this area.
Staff believes this collocation fulfills the City's desire for
collocated users, and that the setback variances, and waivers
of landscaping and wood fence screening are justified for this
site and promote collocation.

Re: Request for WCF located at 724 Chester.
Dear Mr. Connell,
Cricket Communications, Inc. (Cricket) is one of several telecommunications companies
licensed by the Federal Communications Commission (FCC) to provide wireless
communications services within Pulaski County, Arkansas. Cricket is constructing its
wireless network within Pulaski County and has contracted with our company,
SiteExcell, LLC, to provide real estate site acquisition services. In granting the license to
Cricket, the FCC mandates that Cricket provide adequate wireless coverage to the public.
In order to do this, Cricket must construct a network of wireless communications
facilities throughout the Pulaski County metropolitan area. Because Cricket is so
sensitive to community concerns, it has attempted (whenever criteria allows) to target
existing structures or to select sites that have a minimal impact on surrounding properties.
The above referenced property is zoned I-2 with a monopole belonging to ALLTEL
Communications, Inc. already in place. Cricket will sublease a small portion of
ALLTEL's leased parcel for their equipment cabinet. Cricket has filed the attached
Wireless Communication Facility (WCF) Application to grant them the ability to
collocate on this tower. As per the application, Cricket proposes to attach their antennas
at the 137' level. The top of the antennas will not exceed 140'. In addition, due to the
size and location of the existing WCF, Cricket requests to seek awaw r to the
landscaping requirement of the WCF ordinance from the Board of Directors. Cricket will
agree to re -place the 6' chain length fence with an 8' cedar privacy fence around the
WCF compound.
Cricket and SiteExcell, LLC respectfully request that your office and the Board of
Directors approve this application which will allow Cricket to provide adequate service to
its customers as required by its license from the FCC and to better serve the community
as a whole.

This monopole belonging to ALLTEL Communications, Inc. is located in the Northwest corner
of a used car parking lot. To the South is I-630. To the North is a Weekend Theater and Tattoo
Parlor that create a buffer between the compound and 7" Street. To the West and Northwest the
compound is Wooley Electric Motors and Machinery. To the East of the used car lot is Chester
Street and Vino's restaurant is on the corner of Chester and 7'h Street on the East. This area is
obviously highly commercial and industrially zoned property. Landscaping would be impossible
due to the fact that the monopole is located in a parking lot. Furthermore, due to security
reasons, a privacy fence would impede law enforcements ability to properly patrol the site.

This self-supporting tower belonging to Citadel Communications, Inc. is abutted by Snyder
Telecom to the North and West. This building creates a complete buffer from those directions.
To the East and South is a parking lot utilized by Snyder Telecom. This parking lot is
surrounded by a chain link fence. The parking lot fence is lined with trees and shrubs. There is
residential housing to the south of the parking lot but is buffered by the existing landscape. Due
to the asphalt parking lot, landscaping would be impossible, however, Cricket Communications,
Inc. is proposing to install a wooden privacy fence around the compound.

This monopole belonging to Sprint Spectrum, L.P. is abutted by Jefferson Plumbing Supply
Company to the North. Alda's Forever Soap building lies directly (10 feet) South and East of the
site. Mabelvale Pike borders the West side of the compound. Across Mabelvale Pike to the
West is a strip mall that contains a food market, beauty salon and Adult Entertainment Club.
Gene Rush Garage Shop Is to the Northeast of the site. Obviously this site is surrounded by
commercial and industrial property and uses. The compound is asphalt, therefore Cricket would
like to request a waiver from the landscaping requirement. Cricket is, however, proposing to
replace the chain length fence with a wooden privacy one.

This monopole belonging to Sprint Spectrum, L.P. is surrounded by trees and vegetation being
located deep into Reservoir Park. The park driveway is located to the South along with a parking
