_Variance RegUested: The request is filed under the
provisions of Section 31-12(c) to
permit construction of an addition
which will cross a platted 25 foot
building line. The proposed
addition will have a reduced front
yard setback of 16.8 feet.
Justification: This variance is necessary because
of the existing location and
structural configuration of the
house, and the excessive slope of
the lot. The owner wishes to add
an enclosed entry to provide
adequate clearance from an existing
internal stair and provide an
inviting and easily negotiated
transition from the existing
sidewalk on grade to the main
living level. The proposed work
will also enclose an existing open,
roofed porch, but the existing
floor structure of this porch
prevents any level change without
projecting past the setback line.

B. Staff Analysis:
The applicants wish to add to the front of their home a
covered entry and porch and a 6 foot wall which will enclose
a small garden area. The proposed entry, porch and garden
wall will extend past a platted 25 foot building line and
will have a front yard setback of 16.8 feet. The applicant
states that the addition of the enclosed entry will provide
for better clearance from an existing internal stair. The
porch and stairs will enter from the side and will have the
same setback as the enclosed entry. The proposed garden
wall will add to the appearance of the home and will also be
at the same setback.
This property has an extreme slope downward beginning at the
back wall of the residence, limiting the amount of buildable
area available.
The proposed construction will extend 8.3 feet past the
building line. This is a minimal intrusion which should not
have a negative impact on any adjacent properties.
If the building line variance is approved, the applicant
will need to file a one lot replat and an amended Bill of
Assurance to reflect the change in the building line.
C. staff Recommendation:
Staff recommends approval of the requested building line
variance.
BOARD OF ADJUSTMENT: (NOVEMBER 28, 1994)
Mark Alderfer was present representing the applicants. There
were no objectors present. Staff presented the item and a
recommendation of approval. Mr. Alderfer offered no additional
comments.
A motion was made to grant the requested building line variance.
The motion was approved by a vote of 8 ayes, 0 noes and 1 open
position.
