construction of a garage addition
with reduced side and rear yard
setbacks of 5 feet. The ordinance
requires side and rear yard
setbacks of 8 feet and 25 feet
respectively.
The applicants desire to enlarge
the home by converting the existing
garage into a den with a second
floor master bedroom suite. Adding
the new garage to the rear of the
home is the only option and
requires a variance due to the
lot's unusual configuration.

In order for the applicants to continue to live in this
home, it is necessary that they enlarge the structure. They
propose to enclose the existing garage, converting it into a
den and add a second level above it which will contain a
master bedroom suite. To compensate for the loss of the
garage, the applicants wish to construct a new garage
addition to the rear of the home. This new addition will
have side and rear yard setbacks of 5 feet. The ordinance

requires a side yard setback of 8 feet and a rear yard
setback of 25 feet.
Due to the design of the existing home and to have adequate
vehicle maneuverability, it is necessary to place the garage
at the proposed location.
The buildable area available is reduced by a greater than
normal 30 foot building line along Grandview Road and the
lot's unusual shape. The rear lot line of the property
angles sharply, reducing the depth of the lot.
Staff feels that the proposal is justified and supports the
requested variances.
C. Staff Recommendation:
Staff recommends approval of the requested side and rear
yard variances.
BOARD OF ADJUSTMENT: (NOVEMBER 28, 1994)
The applicant, Greg Hartz, was present. There were no objectors
present. Staff presented the item and a recommendation of
approval. Mr. Hartz offered no additional comments.
A motion was made to grant the requested side and rear yard
setback variances. The motion was approved by a vote of 8 ayes,
0 noes and 1 open position.
