Staff Analysis: Z-5911 Mary Lou Smiley Rasco 5021 Crestwood Drive All of Lot 62 and part of Lot 63, Prospect Terrace Addition R-2 From the area regulations of Section 36-254(d) to permit construction of an addition tying the principal structure to the accessory structure and resulting in a reduced rear yard setback of 4 feet. The ordinance requires a rear yard setback of 25 feet. The applicant desires to provide an all-weather connection between the principal structure and the guesthouse which is used occasionally by her disabled son. Single-family residential with detached guesthouse Single-family residential with attachment connecting the house and the guesthouse The applicant proposes to construct an addition to this existing single family residence. The addition will connect the principal dwelling to an existing accessory structure which is used as a guesthouse. Once the addition is complete, the resulting structure will have a rear yard setback of 4 feet. The ordinance requires a rear yard setback of 25 feet. November 28, 1994 4 A portion of the connecting addition will be an open carport and breezeway. The remainder will contain a two-story addition and a storage room. Two mitigating circumstances justify approving this variance. The first being the fact that the accessory structure is already in existence. It currently has a setback of 4 feet, which is appropriate for accessory structures. Only by connecting it to the principal structure does the rear yard setback requirement change to 25 feet. A small portion of the proposed addition will also be within the 25 foot rear yard setback. The second circumstance is the applicant's desire to provide an all-weather connection from the principal structure to the guesthouse which is used occasionally by her disabled son. Staff feels that the proposal is justified and supports the requested variance. C. Staff Recommendation: Staff recommends approval of the requested rear yard setback variance. BOARD OF ADJUSTMENT: (NOVEMBER 28, 1994) The applicants, Terry and Mary Lou Rasco, were present. There were no objectors present. Staff presented the item and a recommendation of approval. Mr. Rasco offered no additional comments. A motion was made to grant the requested rear yard setback variance. The motion was approved by a vote of 8 ayes, 0 noes and 1 open position. 2
