The ordinance requires a rear yard setback of 25 feet. A variance is also requested under the provisions of Section 31-12(c) to permit construction of a canopy which will cross a platted 40 foot building line. The canopy will have a front yard setback of 5 feet. Justification: The buildable area of this lot is greatly limited due to its shallow depth of 100 feet and by the 40 foot building line along the Forbing Road and Geyer Springs Road frontages. Present Use of Propert : Convenience store with gas pumps Proposed Use of Property: Same; the existing store is to be removed and a new building constructed in its place. Staff Re oxt• A. Engineering Issues: I Compliance with the City's Stormwater Detention Ordinance is required. B. Staff Analysis: The applicant proposes to raze and remove the existing convenience store on this property. A new convenience store January 30, 1995 Item No.: A (Cont.) will be built in its place. The existing store consists of a small building and a detached canopy over the gas pump islands. The new store would be larger and the gas island canopy would be attached to the building. The new building is proposed to have a reduced rear yard setback of 1 foot on the south side. The ordinance requires a rear yard setback of 25 feet. The proposed canopy will cross the platted 40 foot building line and will have a setback from the Geyer Springs Road property line of 5 feet. The lot adjacent to the south is zoned C-4 and is occupied by a 4 bay car wash. Allowing the proposed convenience store to have a reduced rear yard setback will not impact the car wash property. A driveway separates the car wash building from the proposed new convenience store. The property line, on the Geyer Springs Road frontage, is setback from the traffic lanes by approximately 10 feet. If constructed with a 5 foot setback from the property line, the canopy will be located 15 feet from the traffic lanes. The support posts for the canopy are located back an additional 10 feet. Staff feels that this will give adequate sight distance and the proposed canopy will not intrude upon the Geyer Springs Road traffic. Staff feels that the proposal is reasonable, due to the shallow depth of the lot and the limiting factor of the 40 foot building line, and supports the requested setback and building line variances. If the building line variance is approved, the applicant will need to file a one lot replat and an amended Bill of Assurance reflecting the change in the building line. C. Staff Recommendation: Staff recommends approval of the requested building line and rear yard setback variances. BOARD OF ADJUSTMENT: (NOVEMBER 28, 1994) The applicant was not present. There were no objectors present. Staff informed the Board that the applicant had not mailed the required notices and was requesting that this item be deferred to the, December 27, 1994 Board meeting. The notices will be sent with the December 27, 1994 date. A motion was made to defer this item to the December 27, 1994 Board meeting. There were no objectors present. The item was moved to the end of the agenda in hopes that the applicant would appear. Staff informed the Board that the required notices had been sent. The applicant did not appear and a motion was made to defer the item to the January 30, 1995 Board of Adjustment meeting. The motion was approved by a vote of 7 ayes, 0 noes, 1 absent and 1 open position. BOARD OF ADJUSTMENT: (JANUARY 30, 1995) William Copeland was present representing Jackpot, Inc. There were no objectors present. Staff presented the item and a recommendation of approval. Mr. Copeland offered no additional comments. A motion was made to approve the requested rear yard setback and building line variances. The motion was approved by a vote of 6 ayes, 0 noes, 2 absent and 1 open position. 3
